周一公布的法庭文件显示,一名联邦法官已下令推进针对人工智能图像开发商Stability AI、Midjourney和在线艺术社区DeviantART的版权侵权案件。该诉讼由Sarah Andersen、Kelly McKernan和Karla Ortiz等艺术家的律师提起,指控开发人员未经许可使用他们的作品来训练各自的人工智能模型。

根据《好莱坞报道》分享的法庭文件,一直负责此案的美国地区法官威廉·奥里克(William Orrick)驳回了根据《数字千年版权法》(DCMA)提出的侵权指控以及“不当得利”指控

然而,Orrick法官确实允许版权和商标侵权的索赔分别向前推进,驳回了被告的驳回动议。

Knobbe Martens律师事务所的知识产权诉讼律师Mark Lezama告诉Decrypt:“法院拒绝驳回艺术家的一些主张,这意味着这些主张在辩护阶段幸存下来,艺术家们可以再打一天。但艺术家们不必解决可能是他们最大的障碍:合理使用辩护。”
