New York alleges Kalshi is operating an unlicensed gambling business by offering event contracts related to sports, elections, and culture. The state sought a temporary restraining order to halt this activity, which the CFTC argued would create a market emergency, potentially stopping Kalshi from offering any event contracts nationwide as it is based in New York. The CFTC asserts that the Commodity Exchange Act gives it exclusive jurisdiction over swaps traded on designated contract markets, which includes the event contracts Kalshi lists. It argues Congress intended to prevent a "patchwork of state gambling laws" from affecting federally regulated derivative exchanges. This clash is part of a broader national debate on whether federal law preempts state gambling laws for such contracts. While a federal judge in a related New York case recently denied Kalshi's motion for a preliminary injunction, finding state gambling laws were not preempted for its sports contracts, the CFTC's latest emergency order allows Kalshi to continue operating. However, it does not resolve the underlying jurisdictional dispute or halt New York's lawsuit. The CFTC has filed similar lawsuits against eight other states to defend its congressionally granted jurisdiction.

SEC and CFTC Sue Goliath Ventures Over $400M Cryptocurrency Ponzi Scheme

The U.S. Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) have filed separate civil lawsuits against Goliath Ventures and its founder, Christopher Delgado, over an alleged $400 million cryptocurrency pyramid scheme. The SEC alleges Goliath raised at least $425 million from over 1,300 investors through an unregistered securities offering, promising to place funds in crypto asset liquidity pools. Instead, the funds were not invested, and Delgado misappropriated at least $51 million for personal use. The CFTC's separate complaint states that around 1,600 clients deposited at least $397 million for purported Bitcoin and Ether trading. Goliath promised monthly returns of 3% to 10%, allegedly from trader fees, and guaranteed principal safety. However, it operated as a Ponzi scheme, using new investor funds to pay earlier ones, while fabricating account statements. The scheme collapsed in late 2025 when it could no longer attract sufficient funds. Delgado has agreed to a two-part settlement with the SEC, which would permanently bar him from securities law violations and participating in the securities industry, pending court approval. He previously pleaded guilty to related criminal charges of wire fraud conspiracy and money laundering. The U.S. Department of Justice noted Goliath raised at least $400 million, causing investor losses of at least $250 million. Delgado has agreed to forfeit assets including real estate, vehicles, and cryptocurrency wallets linked to the scheme.

This push supports Polymarket's renewed focus on the US market after its 2022 exit due to regulatory issues. Despite rapid growth, Polymarket US still trails the US prediction market leader, Kalshi, which saw about $37.7 billion in July volume compared to Polymarket's combined ~$13 billion. Kalshi's valuation also significantly outpaces Polymarket's. The coming autumn, with its slate of sports and political events, presents a critical test for Polymarket's US expansion and its ability to close the gap with Kalshi.
