香港将在月底发布政策宣言,欲成为国际虚拟资产中心

陈茂波透露,特区政府将于10月31日至11月4日举行的金融科技周发布有关虚拟资产在香港发展的政策宣言,向全球业界展示特区政府推动香港发展成国际虚拟资产中心的愿景,以及与全球资产业界一同探索金融创新的承担和决心。

有业内人士分析指出,香港要成为国际虚拟资产中心,必须建构一个可以推动行业发展,又同时兼顾为投资者提供有效保障的监管环境,让虚拟数字资产交易所、金融科技企业、传统金融机构、及个人投资者等共同建设的虚拟资产生态圈。

建国际虚拟资产中心

10月16日,陈茂波在 “司长随笔”中表示,国家《十四五规划》既把香港定位为国际金融中心,也支持香港发展成为国际创新科技中心。香港金融科技发展蓬勃,有着充满活力的生态系统,目前已有逾600家金融科技公司,其中有约三分之一来自海外,它们的业务涵盖移动支付、跨境理财、机械理财顾问、财富及投资管理、合规科技、虚拟资产交易等范畴。

陈茂波透露,一年一度的香港金融科技周将于10月31日至11月4日举行,主题是“突破界限 共创非凡”,将吸引不少嘉宾和参展商积极参与,当中包括超过500家国内外机构和超过200名来自内地、欧美和亚洲多个国家的演讲者,他们将透过线上或线下参与活动。

“特区政府将在金融科技周上发布有关虚拟资产在香港发展的政策宣言,内容涵盖我们的愿景和策略、监管制度、对于开放投资者接触虚拟资产的取态,以及为把握虚拟资产带来的技术优势推出先导项目。政策宣言将清晰表达政府立场,向全球业界展示我们推动香港发展成国际虚拟资产中心的愿景,以及与全球资产业界一同探索金融创新的承担和决心。” 陈茂波说。

“香港发展金融科技有天然的优势。”全球金融科技学院主席、新加坡新跃社科大学教授李国权向元宇宙NEWS记者表示,香港的虚拟资产政策一旦明朗化后,大量的人才聚集,将有利于香港发展成国际虚拟资产中心。

在李国权看来,香港目前积极融入粤港澳大湾区发展,大湾区对金融科技有先行先试的政策优势,同时香港管理着规模庞大的金融资产,这些都为香港发展国际虚拟资产中心提供了便利。

根据中国香港特区证监会数据,目前香港有逾1400间持牌证券行、约110家银行从事经纪活动、逾1700家持牌基金经理。另外,资产管理机构有着总额达4.5万亿美元的在管资产,其中72%来自专业投资者,私人银行已将约8%的资金配置到另类资产中。

“亚洲区内机构投资者与高净值个人投资者对于虚拟资产的需求庞大,大量香港金融机构有意为客户提供虚拟资产服务。”BC科技集团集团CFO胡振邦向元宇宙NEWS记者说道。

胡振邦分析称,我国实行“一国两制”政策让香港处于非常独特的位置,作为全球最自由的城市之一,资金自由流动,实行简单的低税制。以上有利因素为虚拟资产交易、托管、融资等提供了可以信赖的商业环境。

友好的虚拟资产监管政策

作为国际金融中心,香港有着开放的金融理念和政策,这让它在虚拟资产交易的法律监管上显得更为友好。

2017年9月,香港证监会发布了《有关首次代币发行的声明》,视乎个别ICO的事实及情况,所发售或销售的数码代币可能属于《证券及期货条例》所界定的“证券”,并受到香港证券法例的规管。

声明强调,如ICO所涉及的数码代币符合“证券”的定义,就该类数码代币提供交易服务或提供意见,或者管理或推广投资数码代币的基金,均可能构成“受规管活动”。

香港这种稍显温和的监管政策,吸引内地许多虚拟货币领域的企业纷纷迁至香港,甚至还有不少直接将总部迁至香港。

2018年11月,香港证监会发布《有关针对虚拟资产投资组合的管理公司、基金分销商及交易平台营运者的监管框架的声明》,针对加密货币等虚拟资产投资发布新规。

该声明强调,从业机构需申请第1和第9类牌照,用户需是专业投资者,新上架ICO代币需运营12个月或已开始盈利,需为用户虚拟资产购买保险等。

此后在2019年10月,香港证监会出台了《适用于管理投资于虚拟资产的投资组合的持牌法团的标准条款及条件》,从虚拟资产基金管理公司的角度,提出了公司资质、风险管理、合规审计、打击洗钱和反恐的具体要求。

2021年5月,当内地对虚拟资产监管再次收紧时,香港政府则再次细化和强调了相关的监管规则,在鼓励合规发展的同时,也谨慎地寻求监管之道。

2021年11月,香港特区政府财经事务及库务局对加强打击洗钱及恐怖分子资金筹集规管的立法建议进行公众咨询,建议建立虚拟资产服务提供商发牌制度。

今年1月份,香港证监会及金管局联合发布为金融机构拟提供虚拟资产买卖服务规划方向的通知。

该通知允许已登记的金融机构包括券商及银行如果要提供虚拟资产服务,必须与香港证监会持牌的虚拟资产交易平台合作,以提供数字资产投资服务。通告的明确规定将推动香港持牌资管经理、银行和券商对虚拟资产的需求,并使得此类机构可以安全进军迅速增长的虚拟资产生态系统。

不过,在胡振邦看来,香港要想成为国际虚拟资产中心,必须建构一个可以真正推动行业发展,同时兼顾为投资者提供有效保障的监管环境,让虚拟数字资产交易所、金融科技企业、传统金融机构、机构及个人投资者等共同建设香港的虚拟资产生态圈。
