Германский суд оправдал обвиняемого в краже криптовалют на $2,9 млн

Высший земельный суд Брауншвейга оправдал мужчину, обвиняемого в краже криптовалюты на 2,5 млн евро (около $2,9 млн) путем несанкционированного перевода цифровых активов на контролируемые адреса.

Согласно судебным документам, ответчик помог пострадавшему создать криптовалютный адрес и получил доступ к его секретной сид-фразе, состоящей из 24 слов. Затем он перевел 25 млн неназванных токенов с кошелька жертвы на два других криптоадреса, которые истец не контролировал.

Суд отклонил пункт обвинения о краже криптовалют. Согласно статье 242 Уголовного кодекса Германии, кражей считается завладение чужим движимым имуществом. Учитывая, что криптовалюты не имеют физической формы и не могут считаться вещью, обвинение в краже не имеет под собой оснований, решил суд.

Суд постановил, что к этому делу не применимо и «компьютерное мошенничество с использованием электронных средств связи», поскольку транзакция в блокчейне не может быть однозначно связана с манипулированием данными для получения выгоды. Суд также отклонил обвинение в фальсификации данных, сославшись на невозможность идентификации эмитента токенов. Несмотря на то, что обвиняемый избежал уголовного преследования, теперь ему может быть предъявлен гражданский иск.

Немецкая юридическая фирма Winheller, специализирующаяся на криптовалютах, заявила, что решение суда создает огромный пробел в защите пользователей — злоумышленники смогут похищать миллионы в криптовалютах без уголовных последствий. По мнению юристов, в законодательство Германии необходимо внести срочные поправки, связанные с криптовалютами и их кражей.

В феврале партия «Альтернатива для Германии» предложила полностью отменить регулирование биткоина, объясняя желанием привлечь в страну высокотехнологичные проекты и стартапы. В начале года бывший министр финансов Германии Кристиан Линднер (Christian Lindner) предложил три стратегии внедрения биткоина в финансовый сектор экономики страны.
