The head of the Solana Policy Institute, Miller Whitehouse-Levine, stated that the window of opportunity for passing the crypto market structure bill has almost closed. He estimates the likelihood of the bill's approval before the Congressional elections in November 2026 at 10%, reports The Block.
Recall that in early August 2026, the vote on the CLARITY Act was postponed until the end of the U.S. Senate recess, i.e., until mid-September. At the same time, the bill has been in development for over a year.
Against this backdrop, the likelihood of the initiative's approval has decreased, noted Grayscale Investments. Whitehouse-Levine is even convinced that the window of opportunity for passing the bill has effectively already closed.
"Right now, I'd say we are in the 'purgatory' of the August recess. As the term of the current Congress nears its end, passing the bill becomes an increasingly difficult task," he noted in an interview with the publication.
According to the expert, the bill awaits at least several rounds of voting. The head of the Solana Policy Institute still hopes for the CLARITY Act to pass but "soberly assesses the chances."
Whitehouse-Levin believes that the involvement of the President and major counterparties complicates the process:
"Many new stakeholders have emerged who realized: 'Oh no, the CLARITY Act might pass, we better get our act together.' And their attempts to get their act together only mean involving more stakeholders, which always complicates the situation."
Like other industry experts, he is betting on changing the rules at the level of the regulators themselves — the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC).
