SEC审批前夕,灰度为何撤回以太坊期货ETF申请?

Abstract

灰度撤回以太坊期货ETF背后是为提高现货ETF的通过率,还是修改后重新申请,抑或是效仿GBTC做诉讼准备?

5 月 7 日,全球最大的加密资产管理公司 Grayscale Investments 撤回了向美国证券交易委员会(SEC)提交的以太坊期货 ETF 申请文件。

但 Grayscale 并没有说明此举的原因,只是阐述了自 2023 年 9 月 19 日首次提交以来 SEC 多次推迟其申请文件,该监管机构分别在去年 11 月 15 日、 12 月 18 日和今年 3 月 22 日声称需要更多时间来审查该提案。

Grayscale 的这一决定引发一众猜测。

彭博 ETF 高级分析师 James Seyffart 认为,EFT 申请书可能只是一种战略举措,利用其以太坊期货 ETF 作为“特洛伊木马”,旨在创造与 Grayscale 赢得 GBTC 诉讼类似的情况(期货与现货审批结果不一)。去年 8 月,美国联邦上诉法院在针对 SEC 的诉讼中站在 Grayscale 一边,指责 SEC 批准比特币期货 ETF,同时拒绝比特币现货 ETF。

因此 James Seyffart 对 Grayscale 为何现在退出表示疑惑,因为 SEC 必须在 5 月 23 日做出批准或拒绝至少一个现货以太坊 ETF 申请的决定(注:SEC 必须于 5 月 23 日前对 VanEck 的申请做出决定,而 ARK 21 Shares 和 Hashdex 的最终截止日期为 5 月 24 日和 5 月 30 日)。

“在我看来,还不如先让 SEC 批准或拒绝 ETH 期货 ETF,然后在此基础上开始?可能 SEC 和 Grayscale 讨论过此事,并且说服了 Grayscale 的主动退出?(完全是猜测)”。James Seyffart 补充到。

当然也有人推测,Grayscale 可能旨在提高现货 ETF 获批的机率。因为 SEC 可能选择批准以太坊期货 ETF,同时拒绝以太坊现货 ETF。

Seffart 并没有排除 Grayscale 重新提交修改后的申请的可能性,此举会减少 SEC 的工作量,但也会失去诉讼的机会。

“撤回并重新提交申请对 SEC 来说工作量会减少,但同时意味着 Grayscale 或任何人现在都无法提起诉讼”。

此外在 X 推文的评论中,有加密人士认为 Grayscale 撤回申请,是因为 SEC 将批准以太坊现货 ETF,Seyffart 对此不以为然。

“我不认为这种情况会发生(尽管可能性不为零),所以我认为是因为别的事情。 可话虽如此,如果我是 Grayscale,这也确实是我自愿撤回此申请的极少数原因之一。”

SEC审批前夕,灰度为何撤回以太坊期货ETF申请?

值得注意的是,SEC 主席 Gary Gensler 在 5 月 7 日接受 CNBC采访时表示,SEC 仍在权衡其对以太坊现货 ETF 的决定,并再次强调了加密市场中欺诈问题。

“关于以太坊现货 ETF 是我们委员会目前面临的问题,我们是一个由五名成员组成的委员会,这些文件将在适当的时候处理”。

近期,包括摩根大通、渣打银行以及彭博社在内的分析师均认为,现货以太坊 ETF 申请不太可能在 5 月份获得批准。而 Grayscale 的此次撤回申请,以太坊现货 ETF 在 5 月份获得批准的可能性或将进一步降低。
