Президент Польши ветировал законопроект о крипторынке из-за «угрозы свободам граждан»

Президент Польши Кароль Навроцкий наложил вето на законопроект о регулировании криптоактивов, сославшись на риски для гражданских свобод, бизнеса и рыночной стабильности. Решение вызвало резкий политический конфликт между противниками документа и его сторонниками.

Представители криптосообщества поддержало вето, тогда как часть правительства выступила с критикой.

В заявлении администрации говорится, что закон включал положения, позволяющие государству быстро блокировать сайты, связанные с цифровыми активами. Президентская канцелярия отметила, что механизм блокировки доменов непрозрачен и может использоваться злоупотреблением.

По мнению Навроцкого, такая практика создает угрозу правам пользователей и не соответствует европейским примерам более умеренного надзора.

Критика президента также касается масштабности законопроекта. Администрация заявила, что излишняя сложность снизит прозрачность правил и фактически приведет к чрезмерному регулированию по сравнению с Чехией, Словакией или Венгрией. Навроцкий отметил, что перегрузка нормами может вытеснить бизнес в соседние страны и снизить привлекательность Польши для криптокомпаний.

Отдельной проблемой президент назвал размер надзорных сборов. По его словам, эти положения могут замедлить развитие стартапов и создать преимущество для крупных иностранных корпораций и банков. Глава государства подчеркнул, что такая конструкция ограничивает конкуренцию и ухудшает условия для местных компаний.

«Это извращение логики, которое убивает конкурентный рынок и представляет серьезную угрозу инновациям», — сказал он.

Решение о вето вызвало негативную реакцию со стороны ряда министров. Глава Минфина Анджей Доманьский обвинил президента в создании «хаоса». Он заявил, что часть пользователей уже несет убытки из-за мошенничества на рынке.

По его словам, отказ от регулирования может привести к дальнейшим потерям для граждан. Вице-премьер Радослав Сикорский также критически высказался, отметив, что закон был предназначен для защиты поляков от рисков криптовалют.

Представители отрасли, включая экономиста Кшиштофа Пеха, выразили противоположную позицию. Они указали, что действующие механизмы правоохранительных органов не зависят от принятия законопроекта.

Кроме того, эксперты отметили, что регламент MiCA начнет действовать во всех странах ЕС с 1 июля 2026 года. Это, по их мнению, обеспечит единый стандарт защиты инвесторов.

Вопрос о будущем польского регулирования крипторынка остается открытым. Теперь парламенту предстоит решить, будет ли законопроект переработан или повторно вынесен на голосование.

The flow of money is complex and protocol-dependent. In Ethereum, fees consist of a base fee (burned, permanently removing ETH from circulation) and a priority tip (paid to the validator). In Solana, half the base fee is burned and half goes to the validator, while priority fees go entirely to validators. Thus, "fees" are not synonymous with "project revenue"; they may go to network operators or be destroyed. Foundations like the Ethereum Foundation do not take a cut of user fees. They are funded by their own treasuries, which can generate income (e.g., from staking rewards) and finance ecosystem development, research, and security. Their role is to fund public goods that are hard to monetize directly. Developers of open-source blockchain code can monetize through services, not the code itself. For example, Optimism provides its technology freely but sells enterprise support and managed services (OP Enterprise).
