Руководство Kraken заявило, что цифровые активы ADA, SOL, ALGO, MATIC, NEAR, FIL, MANA, FLOW, ICP, OMG и ATOM не являются ценными бумагами. По их словам, биржа не предлагает торговлю традиционными акциями и облигациями, а предоставляет платформу для торговли цифровыми активами, которые не классифицируются как ценные бумаги.

Суд присяжных, по мнению биржи, должен справедливо рассмотреть этот юридический спор, начавшийся еще в ноябре 2023 года. Ранее Kraken уже требовала суд отклонить иск SEC, однако судья отклонил ходатайство биржи.
