Юристы GMT Legal сомневаются в эффективности предложенного законодателями механизма изъятия цифровых активов в рамках уголовных дел. Причина: отсутствие государственных или легальных частных российских кастодианов, объяснил основатель компании Андрей Тугарин.

13 ноября депутаты Госдумы согласовали во втором чтении законопроект, который разрешает арест, изъятие и конфискацию цифровой валюты при рассмотрении уголовных дел. Процедура изъятия криптовалют предполагает ее перевод на контролируемый государством кошелек «при наличии технической возможности».

Сейчас в России отсутствует государственная инфраструктура для хранения и обращения криптовалюты, объяснил Андрей Тугарин.

«Самое удивительное, что при этом вопрос об аресте и тем более изъятии криптовалюты уже вынесен на обсуждение. Изъятие в данном случае означает перевод цифровой валюты с кошелька преступника на кошелек государственных органов. Но такой инфраструктуры не существует. Ни государственных кастодианов, ни частных в России нет», — заявил эксперт.

По словам главы GMT Legal, без технической возможности реальная конфискация криптоактивов и их перевод на баланс государства практически невозможен.

На практике арест цифровых активов преступника может свестись к заморозке его аккаунта на зарубежной криптовалютной бирже либо физическому изъятию материального носителя с ключами. Стоит учитывать, что зарубежные криптоплатформы не всегда обязаны исполнять требования российских силовиков и могут их игнорировать.

Ранее Андрей Тугарин выступил с критикой законопроекта о признании криптовалюты, приобретенной во время брака, совместно нажитым имуществом. Он сказал, что предлагаемый депутатами Госдумы нормативный акт вряд ли окажется жизнеспособным, так как столкнется на практике с целым рядом проблем.

While the acquisition is seen as part of AMD's rivalry with Nvidia in inference, its broader implication lies in challenging the assumption of a permanent HBM memory shortage. The AI memory market is currently booming, with HBM supply sold out through 2026. Yet, Taalas's technology demonstrates that the memory bottleneck is an engineering challenge, not an absolute physical constraint. This aligns with industry-wide efforts from companies like Nvidia (through model compression) and memory makers like Samsung and SK hynix (developing new packaging and storage technologies) to reduce dependency on scarce HBM. AMD's move suggests that the current high prices for memory, driven by AI demand, may not be sustainable. It highlights a growing engineering push against the premise of perpetual memory scarcity, reminding investors that memory has historically been a cyclical business.

Despite pauses in military action and expressions of openness to talks from both sides, negotiations are currently stalled over Iran's economic demands and U.S. insistence on freedom of navigation.
