Texas-based apparel company Beba and crypto lobby group DeFi Education Fund have withdrawn a 2024 lawsuit against the US Securities and Exchange Commission (SEC) over its approach to airdrops, citing a recent shift in the regulator’s approach to crypto.Beba launched a free token airdrop in March 2024 and, together with the DeFi Education Fund, filed a pre-enforcement challenge against the SEC that year.The lawsuit alleged the regulator had adopted its digital asset enforcement policy without a formal notice-and-comment rulemaking process, in violation of the Administrative Procedure Act.The voluntary dismissal, filed in the US District Court for the Western District of Texas on Friday, cites the SEC Crypto Task Force’s work and statements by Commissioner Hester Peirce in several speeches last year suggesting airdropped tokens are not securities.The filing also flags Peirce’s suggestion in May that the SEC is considering an exemption framework for airdrops, and a White House executive action from January encouraging the regulator to establish a “safe harbor for certain airdrops.”“Given the good work done by the SEC Crypto Task Force and recent speeches that suggest a change in the Commission’s position regarding free airdrops, we decided continuing [the case] was unnecessary for the time being and we can re-file if we need to later on,” the DeFi Education Fund said in an X post on Friday.“The DEF team expects that the SEC Crypto Task Force will address airdrops soon—the foundational issue at hand in this lawsuit,” it added.Source: DeFi Education FundCase dismissed without prejudice, for nowThe dismissal was filed without prejudice, preserving Beba’s and the DeFi Education Fund’s right to refile if needed.“Should the expected guidance fail to materialize or be insufficient, Plaintiffs preserve their right to refile thei

The recent slowdown suggests that Bitcoin may be entering a consolidation phase. Despite the pullback, the broader trend remains intact, with BTC still holding above important support zones. Market participants are now closely watching whether this pause is a healthy cooldown before another breakout—or the early stage of a deeper correction.
At the same time, Ethereum has been showing relative strength following its own sharp upward move. Ethereum’s rally has been fueled by renewed investor interest, improving on-chain activity, and growing optimism around the broader altcoin market. As BTC consolidates, capital rotation into ETH and other altcoins is becoming more evident.
This divergence between Bitcoin and Ethereum is a common market pattern. When Bitcoin slows after a strong rally, traders often shift focus toward higher-beta assets like ETH in search of greater short-term gains. As a result, Ethereum can outperform BTC during these consolidation phases.
From a technical standpoint, Bitcoin is currently testing a crucial range between $72K support and $76K resistance. A breakout above this resistance could reignite bullish momentum and open the path toward $80K. On the downside, failure to hold support may lead to a broader market correction.
Meanwhile, Ethereum’s momentum will depend on whether it can sustain its breakout and attract continued inflows. If ETH maintains strength while BTC consolidates, it could mark the beginning of a short-term altcoin rally.

Bitcoin has now gained 23% from its February lows of around $59,900 amid an impressive recovery effort. However, market data shows that the Bitcoin Open Interest has not surged alongside price at the pace it should have, leading to concerns about the sustainability of the ongoing campaign.

Since dropping to a floor of $59,930, the Bitcoin price has recovered 23%, as it currently attempts to establish dominance above $74,000.

However, while the price recovery has led to impressive gains in price, the Bitcoin Open Interest has failed to keep up.

Recently, the Bitcoin price spiked to a higher high of $74,800, but Open Interest only rose modestly to a lower high of $23.3 billion, confirming a concerning divergence.

Such divergence indicates that the ongoing recovery is not receiving any backing from the derivatives market, making it fragile.

Historically, periods of sustained price recoveries have often coincided with corresponding spikes in the Bitcoin Open Interest.
