Super Micro Computer Co-Founder Arrested in Alleged $2.5B AI Chip Smuggling Case
Federal prosecutors have unsealed an indictment charging the co-founder of Super Micro Computer and two associates with conspiring to illegally divert approximately $2.5 billion worth of AI servers equipped with Nvidia chips to China, in violation of U.S. export control laws. The arrests mark the most high-profile enforcement action tied to restricted AI technology exports to date.

Three Charged in Federal Court

The U.S. Attorney’s Office for the Southern District of New York announced the charges on Thursday. Yih-Shyan “Wally” Liaw, a 71-year-old U.S. citizen who co-founded Super Micro, was arrested in California and released on bail. 

Ting-Wei “Willy” Sun, a Taiwan national who worked as a contractor, was also taken into custody and is awaiting a detention hearing. A third defendant, Ruei-Tsang “Steven” Chang, who served as the company’s Taiwan general manager, remains a fugitive.

All three face charges of conspiring to violate the Export Controls Reform Act, which carries a maximum sentence of 20 years in prison, as well as additional counts of conspiracy to smuggle goods and to defraud the United States. “Crimes involving sensitive technology must be met with swift action; the law is meaningless,” said Jay Clayton, the U.S. Attorney for the Southern District of New York.

How the Alleged Scheme Worked

According to the indictment, the operation ran throughout 2024 and 2025. Liaw and Chang allegedly directed executives at an unnamed Southeast Asian company to place purchase orders with Super Micro as though the servers were destined for that region. The servers, packed with Nvidia’s B200 and H200 GPUs, were then reportedly repackaged and forwarded to end users in China.
