Федеральные прокуроры Южного округа Нью-Йорка попросили суд отклонить ходатайство об оправдании разработчика Tornado Cash Романа Шторма. По их словам, представленных доказательств более чем достаточно, чтобы подтвердить его осуждение по обвинению в сговоре.

Шторма признали частично виновным в сговоре с целью осуществления нелицензированной деятельности по переводу денежных средств в августе 2025 года. Однако его адвокаты подали послесудебное ходатайство, утверждая, что обвинение не доказало ни один из трех пунктов дела.

Теперь прокуратура настаивает, что суд должен оставить приговор в силе.

Прокуроры заявили, что доказательства показывают активное участие Шторма в создании и контроле Tornado Cash. В документе отмечено, что он и его партнеры неоднократно изменяли интерфейс сервиса, регулируя способы доступа для пользователей.

По мнению обвинения, это фактически подтверждало его управленческую роль. В прокуратуре заявили, что более 96% пользователей обращались к Tornado Cash именно через этот интерфейс.

Кроме основного обвинения защита добивалась оправдания и по двум дополнительным эпизодам, связанным с отмыванием средств и нарушением санкций. Прокуроры считают, что доказательная база по этим пунктам также была представлена в полном объеме.

В материалах Министерства юстиции США подчеркивается, что Tornado Cash использовался субъектами, находящимися под санкциями, включая киберпреступников и структуры, связанные с Северной Кореей. По их версии, Шторм понимал возможные последствия внедряемых функциональностей и все равно продолжал развивать сервис.
