FTX索赔再受阻,欠中国用户的6.7亿美元不还了?

FTX索赔再受阻,欠中国用户的6.7亿美元不还了?

 月 1 日, FTX 债权人代表 Sunil 发文更新了债权赔偿情况:

  • 2025 年 2 月 18 日,金额小于 5 万美元的用户赔付比例为 120% ;

  • 2025 年 5 月 30 日,金额超过 5 万美元的用户将获得 72.5% 的赔付,金额小于 5 万美元的用户赔付比例为 120% ;

  • 未来预计赔偿发放的时间为: 2026 年 10 月和 12 月,以及 2027 年;

  • 金额超过 5 万美元且已经获得 72.5% 赔付的用户,后续将获得 27.5% 的票面价值赔付,即实现 100% 赔付。(注:根据赔付情况,FTX 债权人在申请赔付后的利息率约在 40-80% 。)

正当债权人们打算安稳地等待赔付到自己时,FTX 的债权索赔又出幺蛾子了。

7 月 4 日,FTX 债权人代表 Sunil 在 X 平台发文表示,包括中国在内的 49 个司法管辖区的债权人可能会失去索赔权,这些地区债权人的索赔资金占总资金的 5% ,约价值 8.25 亿美元(以 165 亿美元总赔付资产计算),其中 82% 属于中国债权人,索赔资产价值约 6.765 亿美元。

可能无法获得索赔的司法管辖区名单

同时,Sunil 表示 FTX 将征求法律意见向受限制的外国司法管辖区进行分配。但如果确定用户属于受限制的外国管辖区,索赔将有争议,用户有 45 天时间提出异议,但如果问题未得到解决,用户将彻底丧失分配权益,其赔付份额将被没收并返回 FTX 清算信托,用于分配给其他国家地区合法债权人。

实际上,在 FTX 于 2 月 18 日正式开始对金额小于 5 万美元的用户赔付时,就表示中国、俄罗斯、埃及、尼日利亚、乌克兰这 5 个地区暂时无法参与索赔分配,其中,中国用户数量最多,占 FTX 总用户数的 8% 。

当时受害用户或会认为索赔受司法地区限制只是暂时性,FTX 未来能够提出解决方案,但今日公布的消息扩大了限制索赔的地区,而且说辞几乎对受限地区债权人的索赔权力判了死刑

对于 FTX 这样的做法,受害用户的愤怒再也压抑不住。用户@zhetengji表示已经联系了纽约的律师并呼吁更多人采取行动:

 我一定会采取行动,并在每个阶段提出异议。 我也希望更多的人能够挺身而出。我们不能只是坐等——这绝对是不合理的。 虽然中国大陆不支持加密货币交易,但中国大陆居民被允许持有加密货币。法律承认虚拟货币的商品属性。 索赔流程使用美元进行结算。尽管外汇管制限制了中国大陆居民每年可以收到的美元金额,但他们被允许在国外持有美元。

中国债权人该如何讨债?

采用法律手段也要考虑成本与收益,对于在 FTX 蒙受几十上百万美元损失的大债权人而言,采用法律手段的成本与收益或许对等;但对于金额小于 5 万美元的用户来说,索赔资金与采用法律途径所耗费的资金和时间精力相比就显得不值当了。

那难道就要看着自己的钱流入他人口袋吗?当然不是,实际上市面上已经有许多为 FTX 债权人提供债权出售服务的第三方平台,如 RootDataclaims marketftxcreditor 和 Xclaim等。为了更细致了解 FTX 中国债权人该如何“讨债”,Odaily 向 RootData FTX 债权解决方案负责人 Loners Liu 了解相关情况:

RootData 主营业务为融资信息平台,也为中国用户提供 FTX 债权出售服务,目前已成功处理 1000+案例,共协助处理债权金额超 3 亿美元。Loners Liu 表示:“你可以把我们理解成像链家一样的中介,我们帮助中国债权人以折扣价出售债权,或者也可以帮助他们托管债权。”

RootData 目前对这项服务收取 1 ~ 2% 的手续费服务,其帮助中国用户处理 FTX 债权主要有以下四种解决方案:

  • 出售债权;

  • 将债权转让在中国境外拥有的实体;

  • 以中国境外的受托人、银行或其他实体的名义转让债权;

  • 更改居住地;

如果是出售债权,首先需要登录 claims.ftx.com 确认 KYC 通过,然后买卖双方需要预约一个视频会议,登录后台核实并签署合同,最后完成转款。

“之前还有人在犹豫要不要主动处理债权,但这几天中国用户 FTX 债权索赔受限的消息传出后,就有很多人来上门咨询了。”Loners Liu 一边回答我的问题,一边回复着债权人发来的咨询消息。

“但是,据我们估算,在中国债权人中,金额超过 5 万美元的用户可能只有 1000 多人”,Loners Liu 表示实际上很多大客户都已经通过各种渠道将债权处理了。

从受损用户的角度,等待多年却拿不到钱无异于晴空霹雳,债权人代表给出的 45 天申诉期、跨国索赔权益再搭配上其令人头大的办事效率又给出一记暴击。此刻,要能折损一定金额(债券转让率+少许手续费),实现部分资金回收,也算是没办法中的好办法。

而若死纠法理、严格维权,面对赚取天价律师费、又手握规则话语权的破产律师团体,中国债权人也着实无处借力。在日新月异,风云转换的加密世界,FTX 暴雷案似乎已距今遥远,但留给所有当事者的伤痕久久不能愈合。最不忍看到的场面,就是当年承载财富梦想的加密货币,终变成美元进入法律团队的腰包。

While the group later burned a large portion of its developer-held tokens (worth over $1 million) to build trust, the fee-generating mechanism remains intact. The game's publisher, Take-Two Interactive, has initiated legal proceedings to identify the hackers. Despite this, the case demonstrates a new model where leaked intellectual property is used as leverage to promote and profit from a cryptocurrency, with meme token markets serving as an additional revenue stream.
