England's Law Commission Seeks Draft Views on Legislation to Label Crypto as Property

Abstract

The Law Commission also called for evidence on its project on digital assets and electronic trade documents in private international law.

The Law Commission, which reviews and recommends changes to laws in England and Wales, published a consultation on draft legislation to label crypto as property.

The independent statutory body's report on digital assets last year showed that crypto tokens and non-fungible tokens were able to attract property rights. Responses are required by March 22.

"Personal property rights are important for many reasons, including in the event of insolvency or where assets are interfered with or unlawfully taken," the commission said on Thursday. "However, because digital assets differ significantly from physical assets, and from rights-based assets like debts and financial securities, they do not fit within traditional categories of personal property."

The Law Commission also called for evidence for its project on digital assets and electronic trade documents in private international law. The deadline for comments in May 16.

Wellington Management oversees over $1.3 trillion in assets. The mWIN token is issued through a Luxembourg-based securitization structure and is designed for use in both TradFi and DeFi. The mWIN strategy is based on an actively managed portfolio of fixed-income instruments, including CLOs, CMBS, RMBS, ABS, and investment-grade corporate bonds. Wellington Management handles the portfolio management, while Northern Trust is the custodian and calculates the daily net asset value. The portfolio composition can be adjusted by Wellington Management in response to market conditions, considering macroeconomic factors, liquidity, and security-specific characteristics, within set constraints for duration and credit quality. The on-chain asset management platform Sentora has added mWIN as collateral on Morpho. On a specific market, PayPal's $PYUSD is used for lending with mWIN as the underlying collateral. Midas also plans integrations with Aave Horizon Market and RWA Hub. mWIN is currently live on the Ethereum network, purchasable with USDC and $PYUSD, with a future launch planned on the Monad network. Investors can access mWIN via Midas or use it in Sentora's vault on Morpho.

Anthropic has announced that starting from August 2, 2026, new Claude models deployed in the European Union will incorporate machine-readable invisible watermarks into generated text. Models released before August 2, 2026 (including the current Claude Opus 5) are in a transitional period and do not embed text watermarks, though Anthropic is working to add support. Currently, there are no public tools to detect these text watermarks; Anthropic states it is developing such tools and will release technical details later. The timing aligns with the EU AI Act's Article 50, which from August 2, 2026, mandates labeling of AI-generated content, with potential fines for non-compliance.
