This "tax nightmare" remains the primary barrier to mainstream adoption in the retail sector.
According to a recent BPI brief, the 119th Congress presents a "once-in-a-decade" opportunity to fix this bottleneck. Lobbying efforts are centered on securing a de minimis tax exemption, similar to those existing for foreign fiat currencies. While Senator Cynthia Lummis has proposed a $300 per-transaction threshold, a rival bipartisan draft aims to limit these exemptions solely to regulated stablecoins—a move BPI argues is too narrow.
Prediction for 2026 and Beyond
The window for this legislative fix is closing rapidly. With the looming 2026 midterms and the scheduled departure of pro-crypto Senator Lummis in early 2027, the next few months are decisive. If a comprehensive package is not passed by late 2026, experts predict that Bitcoin's evolution into a daily payment tool could be delayed by several years, leaving the U.S. lagging behind more crypto-friendly jurisdictions. Conversely, a successful exemption would likely trigger a massive surge in merchant integration and consumer utility.

Bitcoin is currently consolidating around the $70,000 level as the market continues to trade sideways following several weeks of volatility. Price action has remained relatively stable in recent sessions, with buyers and sellers struggling to establish a clear directional trend while liquidity across the broader crypto market remains constrained.

While the surface-level price movement suggests a period of equilibrium, on-chain data indicates that underlying market pressure may be gradually building. A recent report from CryptoQuant highlights a renewed rise in Bitcoin’s Supply in Loss metric, which measures the percentage of circulating BTC currently held at a loss relative to its acquisition price.

According to the data, Bitcoin Supply in Loss is once again approaching the 40–45% range. Historically, this zone has tended to appear during transitional phases of market cycles, particularly during bear market developments or extended corrective periods.

Previous cycles provide a useful reference point. In 2015, 2019, and again in 2022, expansions in the share of coins held at a loss coincided with periods of increasing market stress. As more investors moved into negative territory, selling pressure often intensified as participants realized losses or reduced exposure during uncertain market conditions.

Rising Supply in Loss Points to Increasing Market Stress
The report also highlights a broader structural signal emerging beneath Bitcoin’s current consolidation. As the Supply in Loss metric continues to rise, a growing portion of the market is beginning to hold coins at a price below their acquisition cost. Buyers Return to Bitcoin! According to the analyst, this level must be broken for the decline to end!

As Bitcoin ($BTC) continues its attempts at recovery in recent days, buyers are starting to re-enter the market.

CryptoQuant notes that, according to the data, net Bitcoin purchase volume has increased, indicating that buyers are entering the market.

According to CryptoQuant, net buying volume measures the power imbalance between active buyers and sellers in the derivatives market, and this indicator has been positive since the outbreak of the US-Iran conflict.

This positive trend coincides with Bitcoin’s recent rise to $74,000 and indicates a resurgence in demand for the derivatives market.

Coinbureau CEO Nic Puckrin, pointing to the positive trend in net buying volume, said, “This means that buyers’ volume has surpassed that of sellers. Buyers are now controlling the market.”

The analysis platform Glassnode stated that, at the macro level, the price of $BTC is stuck between the realized price ($54,400) and the actual market price ($78,000).

Glassnode stated that according to their charts, $BTC spent much of 2023 between these two levels, adding, “Unless there are broader macroeconomic downturns, this December market could support a recovery rally.”

However, analysts noted that recovery rallies have repeatedly been stalled near the true market price (currently around $78,000).

Lastly, crypto analyst Titan, using a pseudonym, said that $BTC rising above the $78,000-$80,000 range could signal a change in the long-term trend and reverse the downtrend.

Ethereum treasury companies Bitmine and Sharplink continue to advance their ETH strategy amid the current crypto market downtrend. Bitmine, in particular, continues to accumulate ETH at a steady pace, with the company close to its goal of holding 5% of the token’s supply.  

Ethereum Treasury Company Bitmine Adds More ETH

In a press release, Bitmine revealed that they bought 60,976 ETH last week and now holds a total of 4.535 million ETH worth around $8.91 billion. The Ethereum treasury company has also staked just over 3 million of these tokens to generate yields on its holdings. With its latest purchase, the firm now owns 3.76% of the total token supply and is now over 75% of the way to holding 5% of the supply in just eight months.

Bitmine’s Chairman, Tom Lee, noted that they have staked more ETH than other entities in the world. He further revealed that their staking rewards could reach $259 million annually when their total holdings are fully staked. Lee added that they continue to make progress on their staking solution known as ‘The Made In America Validator Network (NAVAN),’ which they plan to deploy in the first part of this year.
