ЦБ РФ допустит квалифицированных инвесторов к работе с деривативами — СМИ

Банк России работает над расширением инструментов для квалифицированных инвесторов, чтобы брокеры и управляющие компании могли предлагать деривативы, основанные на курсах криптовалют на зарубежных биржах. Об этом пишет РБК со ссылкой на пресс‑службу Центробанка.

Согласно сообщению, инициатива призвана стать очередным шагом к более широкому регулированию рынка цифровых активов.

В ЦБ рассказали, что регуляторные меры еще уточняются. Их цель — устранить препятствия для выпуска не только производных финансовых инструментов (ПФИ), но и структурных облигаций, напрямую связанных с криптоактивами.

В ведомстве отметили, что часть необходимых нормативных документов уже подготовлена.

До сих пор российские инвесторы могли заходить в крипторынок только косвенно — через фонды или инструменты, привязанные к индексам. Прямого доступа к деривативам не было.

В мае 2025 года ЦБ уже разрешил квалифицированным инвесторам вкладывать средства в ПФИ, ценные бумаги и цифровые финансовые активы, доходность которых связана со стоимостью криптовалютных ETF.

12 марта 2025 года Центробанк предложил правительству разрешить сделки с криптовалютами в рамках экспериментального правового режима для «особо квалифицированных» инвесторов. Такой статус могли бы получить граждане:

  • с инвестициями в ценные бумаги и депозиты свыше 100 млн руб;

  • с доходом более 50 млн руб. за предыдущий год.

В комментарии Cointelegraph RU юрист-международник, адвокат «Аграновская и Партнеры», CFA Center Мария Аграновская оценила инициативу регулятора и возможные последствия для рынка.

По ее словам, самый большой риск с точки зрения интеграции зарубежных бирж в отечественные структуры — санкции.

«Поэтому сложно говорить об успешной интеграции. Пример А7А5 известен. Однако “упаковать” отсылку к курсам (индексам/иным цифрам) теоретически возможно», — сказала она.

Эксперт также напомнила, что уже есть примеры структурных продуктов, в том числе в сегменте цифровых финансовых активов и гибридных инструментов.

«Однако, насколько велика их реальная инвестиционная привлекательность, судить не буду. Для тех, кто не может купить криптовалюту в том же Кыргызстане с личной карты или в частной сделке — наверное», — отметила она.

Аграновская добавила, что жесткие ограничения для неквалифицированных инвесторов в секторе не решают проблему.

«Ограничивать круг инвесторов только квалами — лично для меня остается нерешенным. ЦБ, вероятно, виднее. Но результат ограничений таков, что желающие инвестировать идут в теневой рынок. Нет смысла. Никого это не защитит. Защитит только регулирование посредников и создание провайдеров услуг в области виртуальных активов — с лицензиями и контролем их работы», — объяснила она.

Кроме того, по словам юриста, в России по-прежнему отсутствуют необходимые определения для цифровой валюты и стейблкоинов, без которых нормативный контур остается неполным.

Lee reaffirmed the company's commitment to steady buying throughout 2026, expressing belief that the crypto market is still in the early stages of a spring cycle. At the time of writing, ETH was trading around $1,565, while BMNR stock was near $13.56, down over 90% from its 52-week high.
