The newly released 309-page “Clarity Act” is being called one of the most important crypto market structure proposals in years — because it attempts to answer the question the industry has struggled with since the beginning:
What exactly is a digital asset under U.S. law?
The bill creates formal distinctions between: • Securities
• Commodities
• Decentralized protocols
• Payment systems
And it spreads oversight across the SEC, CFTC, Treasury, and banking regulators.
But the biggest shift may be this:
The Act recognizes that some crypto tokens can evolve.
Instead of treating every token as a permanent unregistered security, the proposal creates a pathway for certain assets to transition toward commodity-like status if they become sufficiently decentralized and meet disclosure standards.
That’s a major change from the SEC’s aggressive enforcement approach in recent years.
For crypto investors, this could reduce one of the industry’s biggest risks: Regulatory uncertainty.
The bill also increases pressure on token creators and insiders.
Projects may now be required to: • Disclose token allocations

In a letter signed by chairman Paul Pressler and addressed directly to Cohen, the board outlined six grounds for rejection: eBay’s superior standalone prospects, uncertainty over GameStop’s financing, the impact of the deal on eBay’s long-term growth and profitability, the leverage and operational risks of a combined entity, the valuation implications of those risks, and concerns over GameStop’s governance and executive incentives.

Pressler told Cohen the proposal failed on both counts, credibility and attractiveness, leaving little room for a revised approach.

EBay, which connects millions of buyers and sellers across its global marketplace, has spent recent years sharpening its strategic focus, strengthening its execution, and returning capital to shareholders.

Pressler is confident that the company will continue to deliver value for shareholders, employees, and market participants.

Bakkt posted a net loss of $0.41 per share in Q1 as revenue fell 77% to $243.6 million on lower crypto trading volumes.

Bakkt swung to a first-quarter loss as crypto services revenue fell 77%, underscoring the digital asset platform’s push to reposition itself around stablecoin payments and AI-enabled financial infrastructure.

On Monday, the company reported a net loss attributable to Bakkt of $11.7 million, or 41 cents per basic and diluted share, for the quarter ended March 31. That compares with net income attributable to Bakkt of $7.7 million, or $1.13 per diluted share, a year earlier.

Crypto services revenue fell to $243.6 million from $1.07 billion in the prior year's period, Bakkt said. The company attributed the decline primarily to lower crypto trading volumes. However, nearly all of that revenue figure is offset by crypto costs and brokerage fees, which totaled $242 million in the quarter.

Excluding crypto costs, operating expenses held steady at $18.5 million, down slightly from $18.9 million a year ago. The net loss was $11.7 million, compared to net income of $7.7 million a year ago.

Bakkt ended the quarter with $82.6 million in cash, including $69.6 million raised through equity offerings during the period. The company also revealed that it carries no long-term debt

OpenAI offers European Union access to advanced cybersecurity AI model

OpenAI is in active talks with the European Commission to grant access to its most advanced cybersecurity-focused AI model, one capable of identifying software vulnerabilities. The move positions the ChatGPT maker as the first major AI lab to open its cyber capabilities to EU regulators, who have been struggling for weeks to assess the security risks posed by frontier AI systems.

The timing is pointed. Anthropic, OpenAI’s chief rival in the safety-conscious AI race, has not yet authorized the EU to access its own cybersecurity model, Mythos.

What the model actually does
OpenAI’s cybersecurity model, referred to as GPT-5.5-Cyber, is specifically engineered to identify software flaws and simulate intrusions.

As of May 1, GPT-5.5 completed a full simulated corporate network hack, making it only the second AI system to accomplish that feat. The first was Anthropic’s Mythos. The two models now appear to be roughly matched in their ability to break into simulated enterprise environments.

Under the AI Act, European regulators need to evaluate the cybersecurity risks that advanced AI models introduce. By granting direct access, OpenAI is effectively letting the Commission kick the tires on its most capable cyber tool.

Why crypto should be paying attention
Financial losses from crypto hacks exceeded $1.5 billion in 2025. If AI models can simulate corporate network hacks, they can also be pointed at smart contracts, bridge protocols, and DeFi platforms.

Recent months have already seen reports of scams exploiting AI agents for crypto theft. The threat landscape is evolving in real time, with attackers leveraging AI tools to automate phishing, social engineering, and exploit discovery.

Technical analysts now consider the $78K to $80K area as critical support for maintaining bullish momentum. If Bitcoin successfully breaks above the $85K resistance zone, many traders believe the market could quickly target even higher levels in the coming weeks.

While market sentiment is improving, analysts warn that macroeconomic events, Federal Reserve policy, and ETF inflows will continue playing a major role in determining Bitcoin’s next direction.
