1 月 21 日凌晨,美国证券交易委员会(SEC)正式发布声明宣布,今天将是 Gary Gensler 履职 SEC 主席的最后一天。这位在过去三年多的时间内与加密货币行业纠葛无数的 SEC 掌门人,终于迎来了告别之日。

随后不久,白宫方面再次发布文件,宣布现任 SEC 委员 Mark Uyeda 将担任 SEC 代理主席,其将在新任 SEC 主席(预计为 Paul Atkins)确定并上任之前暂时领导 SEC 这一对行业监管至关重要的机构。

Uyeda 为共和党成员,其自 2022 年 6 月 30 日起开始担任 SEC 委员。在成为 SEC 委员之前,Uyeda 曾在 SEC 任职超过 15 年,有着丰富的一线工作经验。

对加密货币的态度如何?

在关于加密货币方面,Uyeda 一直都持友好态度,其曾与「加密妈妈」Hester Peirce 一同被业界视为在 SEC 内的坚定盟友。

在去年关于整个行业发展的 ETF 决议事宜上,Uyeda 也投出了至关重要的赞成票。

虽然身处 SEC,但 Uyeda 并不赞同 Gary Gensler 对业界的强势执法行为,其曾与 Peirce 一起反对过 SEC 针对业界项目所发起的多项执法行动。

去年 10 月,Uyeda 在接受 Fox Business 采访时曾表示,特朗普曾将 SEC 过往的行动描述为「对加密货币的战争」,必须终结这一局面,并制定更明确的监管准则。

「我认为我们过去几年的政策和做法对整个加密行业来说真的是一场灾难。我们一直在推行『强制执法政策』,我们没有做任何事情来提供指导。」

上周,路透社报道表示,多位知情人士透露 SEC 的共和党高层准备在特朗普上台后立即开始改革该机构的加密货币政策。Uyeda 和 Peirce  正在考虑的措施包括启动相关程序,最终制定指导意见或规则,明确该机构在什么情况下将加密货币视为证券,并审查一些正在法院审理的加密货币执法案件。

SEC 后续接任事宜

需要强调的是,Uyeda 仅为 SEC 代理主席。特朗普已提名前 SEC 委员 Paul Atkins 正式执掌该机构,但目前尚不清楚 Atkins 的任命何时能获得批准,但预计在 Atkins 接手之前,Uyeda 仍将作为该机构的临时掌门人作出一些实质性的政策改变。

至于 Atkins 接任后的潜在态度变化也无需太过担心。Atkins 曾是 Peirce 和 Uyeda 的下属,虽然关于加密货币的明确表态相对较少,但他也曾公开批评过 SEC 对于加密货币行业的过度监管。

结合过往履历及潜在态度来看,Atkins 的态度应该也偏向于支持加密货币。

CFTC 同迎换届

除了 SEC 之外,另一大核心监管机构商品期货交易委员会(CFTC)也迎来了换届。Rostin Behnam 已卸任,特朗普已提名 Caroline Pham 担任 CFTC 代理主席,预计后期将转任常任主席。

与 Atkins 类似,虽然 Pham 也没有像 Uyeda 那样直言不讳地承认支持加密货币,但市场仍预期 Pham 会对行业持相对友好的态度。

风向转变的开始

随着特朗普的已正式就职,以及 SEC、CFTC 等核心监管机构的换届,加密货币的监管风向转变已然开始。

对于长期饱受监管困扰的加密货币行业而言,接下来的几年可能会是行业历史上生长环境最为宽松的几年——虽然这段多少与拉拢选票存在关联的「蜜月期」本身就稍显脆弱。

信奉去中心化的理想主义者们可能会抱怨,寄望于政治环境的现状绝非中本聪写下比特币白皮书时的初衷,但从现实主义出发,接下来的这段监管春天或将是业内各方寻求发展的最佳契机。
