消失的13万个虚拟货币去哪了?宜兴检察提醒关注虚拟货币交易平台安全性

近年来,虚拟货币圈热度较高,不少投资者对此跃跃欲试,但是账户真的安全吗?有时只需点击一个按钮,账户内的虚拟货币就可能被他人偷偷转走。近日,经宜兴市检察院提起公诉,法院以盗窃罪判处被告人王某有期徒刑十一年,并处相应罚金。此案就是一起以非法占有为目的,通过非法获取他人虚拟货币钱包权限后窃取被害人虚拟货币的案件。


家住宜兴的潘女士是一位虚拟货币投资爱好者。2022年10月,在朋友的介绍下,潘女士结识了一位所谓的区块链“大师”王某,王某不仅给她和一些虚拟货币爱好者免费授课讲解区块链专业知识,还为她们解答不少投资方面的疑惑。在聊天过程中,王某向潘女士推荐一个新开的虚拟货币交易网站,并称对于前期参与的一些用户,平台方会赠送其虚拟币,操作非常简单,只需在网站上绑定自己虚拟币的钱包即可。

这引起了潘女士的兴趣,她立刻在王某的指导下,在该网站上绑定自己的虚拟币个人钱包。但此时,潘女士的虚拟币全部在交易所,她的个人钱包中并没有多少虚拟货币,授权也只是为了坐等项目方发放福利。在授课过程中,王某向潘女士透露世界第二大虚拟货币交易所暴雷,导致很多投资者放在交易所的虚拟货币都取不出来,建议潘女士把币放在个人钱包中更加安全。潘女士按照王某的建议将自己在三个交易所中的13余万个虚拟货币全部转到个人钱包中。

然而没过两天,潘女士就发现个人钱包中虚拟货币全都不翼而飞。她查询后得知钱包里的虚拟货币被授权的钱包地址转走了,而该钱包地址正是王某之前让自己授权的。潘女士遂向宜兴市公安局报案。2023年1月,王某被宜兴警方抓获归案。2023年5月,案件移送至检察机关。


承办检察官审阅案卷后发现,为了能够隐秘地获取他人虚拟钱包权限,王某与他人合谋制作了一个表面是区块链项目的网站,通过普及区块链知识等方式,借机推广该网站,诱骗他人在网站上授权绑定个人虚拟货币钱包。而王某正是借助网站授权功能获取了潘女士钱包的管理权限。经统计,王某将潘女士账户内13万个虚拟货币转走变现至自己的银行卡,造成潘女士经济损失90余万元。

承办检察官通过对案件性质的详细论证、分析研判、结合全案证据,认为虚拟货币具有财产属性,认为王某以非法占有为目的,通过非法获取他人虚拟货币钱包权限后窃取被害人虚拟货币,涉嫌盗窃罪、诈骗罪和非法获取计算机信息系统数据罪等多个罪名,数额特别巨大,检察机关以涉嫌盗窃罪对王某依法提起公诉。经开庭审理,法院采纳检察机关量刑建议,依法作出判决。后王某不服一审判决提出上诉,无锡中院经审理裁定驳回上诉,维持上述判决。

虚拟货币的交易过程和交易平台目前缺乏有效监管,存在一定安全风险。检察官提醒公众,关注虚拟货币市场和交易平台的安全性,选择正规、合法、安全的交易渠道进行投资和交易,牢记天上不会掉馅饼。同时,也要加强自我保护意识,不轻易泄露个人信息和密码,特别要警惕利用虚拟货币进行盗窃、诈骗、洗钱等违法行为,一旦发现,要及时报警。
