尼日利亚加密货币倡导者James Utudor已对政府提起诉讼,针对加密货币的严格限制。

该诉讼点名总统、财政部长、总检察长和几个关键机构,包括尼日利亚中央银行和证券交易委员会。

詹姆斯的法律团队认为,政府的行为是违宪的,并援引“AG Kaduna State V.Omoru Hassan(1985)”一案作为关键先例。

他们声称,通过限制对加密货币的访问,政府侵犯了宪法第4章所保障的权利。

James的律师Maurice Ebam指出,比特币和USDT不仅仅是加密货币,它们是有助于抵御通货膨胀和促进国际贸易的资产。

“《宪法》第43条保障每个尼日利亚人在尼日利亚任何地方获得和拥有财产的权利。”

该诉讼称,这一权利自然应延伸到加密货币,加密货币在当今经济中越来越重要。

詹姆斯还援引了《非洲人权和人民权利宪章》第14条,该条保护财产权。

该诉讼声称,政府要求电信公司阻止访问加密货币平台的指令显然是越权。
