В службе напомнили, что до 25 апреля юрлица, добывающие криптовалюты, должны впервые сдать декларации по налогу на прибыль

На 1 апреля в Федеральной налоговой службе (ФНС) зарегистрировались 722 компании и ИП, из которых 116 — это операторы майнинговой инфраструктуры, и 606 — майнеры. По данным службы, больше всего легальных майнеров в Красноярском крае, Иркутской области и Татарстане.

Центры обработки данных (ЦОДы), предоставляющие инфраструктуру для майнеров, помимо перечисленных регионов также зарегистрированы в Мурманской, Саратовской, Воронежской областях, в Москве, Санкт-Петербурге, Ямало-Ненецком автономном округе, Алтайском крае и ряде других регионов, сообщили в эфире программы «PRO налоги».

Все юрлица и ИП в России, добывающие криптовалюту, обязаны регистрироваться в специальном реестре ФНС. Физлицам этого делать не нужно, если они занимаются майнингом, используя электроэнергию не более чем на 6 тыс. кВт⋅ч в месяц.

Также всем майнерам (физлицам, ИП и компаниям) необходимо ежемесячно отчитываться о добытой криптовалюте. Заместитель руководителя ФНС России Виталий Колесников напомнил, что до 25 апреля майнеры-юрлица должны впервые сдать декларации по налогу на прибыль.

Колесников отметил, что для удобства расчета налоговой базы для майнеров на сайте ФНС появилась страница с курсами криптовалют и объемами торгов у «иностранных организаторов торгов» — крупнейших криптобирж. Служба видит «налоговый потенциал» от развития отрасли майнинга, в том числе интересный и для регионов, в бюджет которых придут поступления от зарегистрированных там майнеров, отметил замглавы ФНС.

Он обратил внимание на то, что пока рано оценивать размеры первых предстоящих налоговых поступлений от майнинга. По его словам, в первую очередь, необходимо вывести индустрию добычи криптовалют из тени:

«Для нас сегодня важно легализовать рынок, сделать его абсолютно прозрачным, нормальным, как в любой другой отрасли», — подчеркнул Колесников.

Одна из причин, по которой нелегальные майнеры не торопятся заявить о себе в ФНС, это неопределенность с оборудованием, которое было завезено ранее по серым схемам, поскольку при регистрации в реестре налоговой нужно указывать все данные об устройствах. «Амнистия майнеров» или легализация незаконно ввезенного в Россию майнингового оборудования необходима, считают в Госдуме. Этот вопрос уже обсуждается при участии Федеральной таможенной службы.
