长推:加密市场多年的“暧昧”监管关系失衡了

关于SEC起诉币安的监管风暴愈演愈烈了。无论是FUD cz_binance 挪用客户资金或非法洗钱,还是非议Gensler公报私仇都有些“对人不对事”。

关于SEC起诉币安的监管风暴愈演愈烈了。无论是FUD @cz_binance 挪用客户资金或非法洗钱,还是非议Gensler公报私仇都有些“对人不对事”。
真正的“事”是ETH等代币是不是Security?这个定义问责权在于最高法院,
眼下SEC和Binance的恩怨纠葛仅反应了一个事实:加密市场多年的“暧昧”监管关系失衡了。
多年的监管平衡是什么?一个词“暧昧”,既不能过度管制扼杀掉创新和发展,也不能任由行业乱搞滋生金融风险。
因此,多年来监管机构和Crypto行业的权限责任义务等互动边界非常模糊,不能算对立但也不能算合作,就处于微妙的灰色地带,犯了事罚点款拍打拍打,交给市场自然进化逐渐带动监管的渗透。
加密行业历史上,EOS、Kraken、Tezos等都有过先例,最终都以罚款作为阶段性的tradeoff。
不过,这次SEC向Binance交易所发起上诉的态度急切且乱施“杀威棒”,简单罚款怕很难了结。
但也不至于说成美国的94害怕黑天鹅,毕竟SEC起诉Binance和七部委禁止ICO完全不是一个行政级别,影响自然相形见绌。
个人抛砖引玉认为,这场风暴背后折射了监管对加密行业的“失控”焦虑,表现在:
1)监管开始觉得VASPs的迎合态度阳奉阴违?
起初FATF、Travel Rule等步调是:先逐步发牌照给中心化VASPs实施监管,再用技术手段对Non-Custody去中心化DeFi协议进一步监管;这样做可以借CEX的“顺从”来抗衡DEX的无从下手。
先扼住VASPs中心化流动性的咽喉,再设法啃去中心化的硬骨头。这样监管其实颇有“政治智慧”。
事实上,纵观过去数年诸多VASPs也基本都在积极迎合监管,Rank顶流的Binance更是首当其冲:
比如:Binance总站退出美国市场,推出US子站,以及成立超750人的合规团队等等无不反应币安积极迎合监管的态度。
但Binance忽略了美国在政治作风上惯有的“霸权”思维。从2019年拒绝配合SEC调查,到强行收购CoinMarketCap,再到拒绝提供审计报告信息等,甚至此次监管汹汹下的Strong Together公关PR也可看出端倪。
SEC开始觉得,Binance的迎合态度“强硬且不够舔”,有阳奉阴违之嫌,有损监管机构威严,不加码整你?
2)Binance在加密行业全球流动性的“垄断”地位在凸显。
即使在传统web2领域,一家公司出现垄断性竞争优势也会被针对,何况在激进的web3领域。
据未必精确的数据显示,Biance占crypto全球交易量份额在50-65%,全球用户超1亿,每日交易额超700亿美元,每月交易量超其他顶级交易所2-5倍 @heyibinance
事实上,近半年以来,包括闺蜜币lauchpad、老鼠仓、IEO收益下滑的种种FUD币安,无不映射市场社区KOL对币安这位巨无霸的忌惮。何况非善茬者也SEC呢?
SEC原本指望DeFi等去中心化世界能够和CEX分庭抗礼,谁曾想,Crypto市场流动性竟越发聚集了?而且还在一个完全不受自己掌控的叛逆者手里,这能忍?
3)FTX交易所暴雷给监管机构上了一课。
真不想把FTX以及Sam等币圈甲级战犯拿出来“鞭尸”,但SEC和Binance之间暧昧关系的打破,和FTX暴雷造成的市场余悸有剪不断理的渊源。
典型表现在,把总公司设在巴哈马,成立US子公司接受监管的做法,FTX用血的事实验证了不可行,监管还会信同样套路的Binance吗?
因为,监管机构开始意识到,Crypto市场的投资裙带、资产杠杆率range、业务组合性等尤为复杂,若不能监管大部分流动性,一旦蝴蝶煽动翅膀没准就是一次不可逆死亡螺旋,比如,被献祭的LUNA等。
显然,FTX暴雷给监管机构们美美上了一课,让监管子公司以保护母公司的迎合监管行为被打破了暧昧磁场。
综上,可以看出此次SEC毫无章法的监管举措,本质上是对突变的Crypto加密环境失控的焦虑。
短期会让市场陷入恐慌,但如果理清其中的复杂关系与矛盾,自然会对市场的长期发展再次充满信心。
换个角度思考:监管焦虑VASPs流动性的过于集中,不也是变相对去中心化DeFi世界的暗自助威吗?治治CZ吧!
至于此次监管风暴要持续多久,会以怎样的形式结束,我持乐观态度,因为整体的监管脉络并没有变:
FATF、Travel Rule、CFTC、SEC等先以牌照高效监管中心化VASPs,默许让DeFi去中心化世界和CEX相互抗衡数年,最终很可能会用诸如ZK-SNARK之类的创新技术手段来辅助监管与合规。

Both will be recalibrated within eight hours. First, at 20:30 Beijing time, the US Bureau of Economic Analysis releases July PCE inflation data and the second estimate of Q2 GDP. Consensus expects mild core PCE growth, but a surge in key PPI components poses an upside risk. A hotter-than-expected print could push Treasury yields and the dollar higher, threatening the recent rally in Bitcoin (BTC) above $80K, which was fueled by falling yields.
