Gary Gensler 辞职倒计时?谁会是下一届 SEC 掌舵者?

7 月 22 日,包括 10x Research 在内的多家机构及媒体均预测表示,随着拜登退选,现任美国证券交易委员会(SEC)主席 Gary Gensler 预计可能将于 2025 年初辞职。

从 2021 年 4 月担任 SEC 主席至今,Gensler 任期已过大半。在任期内,Gensler 频繁向加密货币行业「开炮」,主导了针对币安、Coinbase、Kraken 以及 FTX 等众多知名加密企业的案件,并曾多次发表诸如「加密市场的代币绝大多数都属于证券,所以发布和销售这些证券型加密代币会受到证券法的监管」等强势监管言论。

也正是因为如此,Gensler 一直都被业界视为监管侧的「头号公敌」,而随着 Gensler 或将提前辞职的消息传出,加密货币行业也开始期待一个态度更加友好的人物掌舵 SEC,进而为行业提供一个更为宽松的生长环境。

Gensler 会提前下台吗?

从任期来看,Gensler 的工作本将持续到 2026 年,但 SEC 主席选择在政府换届时辞职早已成为了惯例。

小布什曾任命 Christopher Cox 为 SEC 主席,任期为 2005 年 8 月至 2009 年 1 月,但当奥巴马上任后,Cox 很快就选择了辞职。

奥巴马所选择的 SEC 主席 Mary Jo White 的既定任期为 2013 年 4 月至 2017 年 1 月,但当特朗普第一次获选总统后,她也在 2016 年 11 月提交了辞呈。

针对 Gensler 是否会提前离职,本届 SEC 五大委员之一的 Hester Peirce(也是继任者热门人选之一,下文细说)日前接受采访时也曾隐约地暗示了这一可能性:「如果总统发生了变化,SEC 主席通常也会随之变化。」

不过,Peirce 没有对潜在的继任者做出任何预测,而是强调新总统在选择下一任主席方面将拥有充分的自由裁量权。

考虑到当前拜登已然退选,白宫易主已成定局,尤其是考虑到当前共和党的总统候选人特朗普在获选概率上大幅领跑,而特朗普所选择的竞选搭档 J.D. Vance 此前曾公开抨击 Gensler 的工作,若特朗普顺利上位,Gensler 将会面临巨大的政治压力。

相对而言,若当前明显处于落后位置的民主党能够守擂成功,Gensler 继续履职的概率应该会稍大一些,但也不排除哈里斯或其他总统候选人(民主党尚未确定总统候选人,但哈里斯的概率较大)会出于拉拢更多「盟友」的考量而撤换掉树敌颇多的 Gensler。

接任者可能是谁?

随着 Gensler 或提前辞职的传言流出,关于潜在继任者的猜测也越来越多。

CNBC 近期曾报道表示,一些加密货币投资者已向特朗普提交了几个名字作为 Gensler 的潜在继任者,包括特朗普第一个任期内的两位商品期货交易委员会主席(CFTC)J. Christopher Giancarlo 和 Heath Tarbert,现任 Robinhood 首席法务官、曾担任两届 SEC 委员的 Dan Gallagher,以及曾在小布什政府担任 SEC 委员的 Paul Atkins。

J. Christopher Giancarlo

对于加密货币行业内的「老人」而言,J. Christopher Giancarlo 和 Heath Tarbert 的名字可能并不陌生,尤其是曾被业界赞为「CryptoDad」的 Giancarlo。

Giancarlo 本人不仅在 CFTC 任期内对加密货币持相当友好的态度,还曾在卸任 CFTC 主席后出书《CryptoDad: The Fight for the Future of Money》,讲述了他在任职期间为合规比特币期货打开绿灯的故事。

值得一提的是,Giancarlo 卸任后还曾加入过一些业内公司,比如担任过 Paxos 的董事以及 Polymarket 的顾问委员会主席。

Heath Tarbert

Heath Tarbert 是 Giancarlo 在 CFTC 的继任者,与 Giancarlo 一样,Tarbert 也是一位知名的加密货币支持者。

Tarbert 在 CFTC 任期内主导了合规以太坊期货及比特币期权产品的上市,曾公开表示「美国的监管落后于加密货币与区块链的发展」以及「DeFi 的理念是革命性的」等支持性言论。在卸任后,Tarbert 则是加入了 Circle 担任首席法务官。

Dan Gallagher

Dan Gallagher 如今的职位是 Robinhood 首席法务官,Robinhood 当前已是 Web2 中涉币业务最多的公司之一。2022 年,Gallagher 曾公开发言表示:「不要对加密货币行业进行过度监管,因为这可能会扼杀创新。」

Gallagher 也是少有的曾回应接棒事宜的潜在继任者,在回给 CNBC 的声明中,Gallagher 表示很荣幸被提名为特朗普政府的 SEC 主席。

Paul Atkins

相对于前边几人,Paul Atkins 关于加密货币的明确表态相对较少,但他也曾公开批评过 SEC 对于加密货币行业的过度监管。

在接受 CNBC 关于 SEC 问题的采访时,Atkins 表示:「那里现在一团糟……我认为还有很多工作要做,且必须改变做法。」

Atkins 补充表示,暂时并没有从特朗普及其团队那里听说过他可能在该机构担任什么职务,但当问及如果特朗普获胜,是否会接受 SEC 的工作时,Atkins 的回答是:「谁知道呢?」

Hester Peirce

除了 CNBC 报道的四个人之外,现任 SEC 共和党委员 Hester Peirce 也被视为 Gensler 的热门继位人选,至少是 Gensler 离职后的代理主席人选。

与 Gensler 完全相反,你可以将 Peirce 视为加密货币行业在监管侧的「最佳盟友」。在你记得住的几乎关于加密货币的监管动态中,包括 ETF、SAB-121 以及多起诉讼行动等等,Peirce 几乎一直都站在支持加密货币的这一边。

由于长期以来对加密货币的友好态度,Peirce 也被业界赋予了一个善意的昵称 CryptoMom —— 虽然她本人最近曾回应表示:「我不是你妈…」

虽然 Peirce 本人并未直接回应接任 SEC 主席的可能性,但她已得到了一些议院力量的支持。正在竞选众议院金融服务委员会主席的众议员 French Hill 近期在接受采访时表示:「我不确定 Peirce 本人的意愿,但我认为她是下人 SEC 的绝佳人选,她可以成为一个很好的主席。」

加密货币的监管春天

总而言之,Gensler 的提前卸任似乎已是大概率事件,而从潜在的继任者角度来看,当前媒体已曝出的名字几乎都对加密货币持有相对友好的态度。

对于长期饱受监管困扰的加密货币行业而言,接下来的几年可能会是行业历史上生长环境最为宽松的几年 —— 虽然这段多少与拉拢选票存在关联的「蜜月期」本身就稍显脆弱。

信奉去中心化的理想主义者们可能会抱怨,寄望于政治环境的现状绝非中本聪写下比特币白皮书时的初衷,但从现实主义出发,接下来的这段监管春天或将是业内各方寻求发展的最佳契机。
