U.S. prosecutors have asked a federal judge to reject a request from former FTX CEO Sam Bankman-Fried for a new trial, arguing that the imprisoned crypto executive has failed to present any legitimate new evidence.
The request, filed in February by Bankman-Fried’s mother on his behalf, sought to reopen the case that led to his 2023 conviction for fraud and conspiracy related to the collapse of the crypto exchange FTX. He was later sentenced to 25 years in prison.
In the motion, Bankman-Fried argued that testimony from two former FTX executives—Daniel Chapsky and Ryan Salame—could have challenged the prosecution’s claim that he defrauded FTX customers. According to the filing, both individuals allegedly chose not to testify during the trial due to fears of retaliation.
However, prosecutors strongly rejected that argument. In a recent court filing, they stated that both witnesses were already known to the defense before the trial, meaning their potential testimony cannot be considered newly discovered evidence.
Prosecutors also noted that the defense’s decision not to include these individuals on the witness list—or to compel their testimony—undermines the claim that their post-trial statements should justify reopening the case.
Furthermore, prosecutors emphasized that even if the testimony were considered, it would not have changed the outcome of the trial. They pointed to overwhelming evidence showing that Bankman-Fried directed the transfer of billions of dollars in customer funds from FTX to his affiliated trading firm, Alameda Research.
Bankman-Fried’s motion also repeated his long-standing argument that FTX was not truly insolvent and that customers might eventually be repaid. Prosecutors dismissed this claim as well, noting that FTX held only about 105 Bitcoin at one point while customer claims approached nearly 100,000 Bitcoin.
