FTX破产风波还在延续,前首席执行官SBF也一直处于聚光灯下——虽然都不是什么好事。

根据最新消息披露,对于SBF关于“一旦了解清楚事件经过,愿意就FTX崩盘在国会作证”的说法,美国众议院金融服务委员会主席Maxine Waters在推特上回应称:“根据你作为前CEO的角色和过去几周的媒体采访,我们很清楚,你迄今为止掌握的信息足以参与作证。FTX的崩溃已经伤害了上百万人,你的证词不仅对国会议员有意义,而且对美国人民也很重要。你必须在13日参加听证会,如果以后有更多信息要分享,我们愿意继续举行听证会。”这意味着,SBF将会被“传唤”到众议院金融服务委员会,而不是被“邀请”作证。

与此同时,人们不禁在问:为什么SBF还不坐牢?

坦率地说,这个问题的答案其实非常简单:尽管每个人都知道SBF犯了大错,但截至目前,仍无法确认他是否存在任何犯罪行为。

SBF的继任者John Jay Ray III曾负责处理过著名的“安然破产案”,但当他看到FTX公司状况后也忍不住感慨“从未见过如此失败的公司治理、如此混乱的公司财务信息”,如果不是公司管理层无能,那么这种行为几乎可以算是“犯罪”。

然而根据法律专家分析,至少在FTX调查完成之前,SBF应该不会被很快关进监狱,而调查过程似乎十分漫长,因为这不是一个简单的案件,FTX不是传统金融公司,加密世界异常复杂。

lWeb3律师Charles Slamowitz解释说:“虽然有法规和限制,FTX客户中任有2%来自美国,但拥有100多家实体的FTX总部设在巴哈马,也就是说,尽管美国人赔了钱,但由于SBF、FTX和巴哈马之间盘根错节的联系,会让美国监管者和执法机构难以介入。其次,作为一种新兴事物,许多检察官并不了解加密货币行业,更不清楚如何调查这种大规模的欺诈行为。因此,收集诉讼信息并提出指控会异常复杂,所以即便起诉SBF只是时间问题,但这个时间可能会比想象中的更久。”

lDorsey & Whitney LLP是一家专门为美国证券交易委员会调查和执法行动以及刑事白领证券案件提供辩护服务的律所,其合伙人Thomas Gorman也有同样的看法,认为巴哈马政府的介入让事情变得复杂化,他解释说“这会产生一些问题,假设SBF最终被指控的话。会有不同的法律来处理FTX的不同方面,最终将影响谁会被指控、以及因为什么罪名而被指控”。

值得一提的是,巴哈马和美国确实有引渡条约。

Thomas Gorman补充称,现在华盛顿特区里已经有人开始调查SBF,但没有人明确指出是否会对SBF提出刑事指控,可即便提出指控,SBF还是需要一段时间才会入狱。

与此同时,虽然SBF有权保持沉默以避免自证其罪,但他似乎耐不住寂寞,不仅接受了几次备受瞩目的采访,而且还时不时地在社交媒体上发帖,甚至在接受《纽约时报》采访时声称不明白FTX发生了什么事,更辩解自己“没有故意混合资金”,SBF的这些举动令人感到疑惑,但有分析称,他很可能在进行一场“魅力运动”以尽量减少自己的罪恶感。

如果SBF真的用管理不善、能力不足这些作为借口,执法者会买账吗?我们只能拭目以待。

Following the hack, an unverified X account impersonating Jaredfromsubway.eth emerged, falsely offering a bounty for the return of funds, prompting developer warnings for users to stay vigilant.
