Ripple 再度「胜诉」,被罚 1.25 亿美元远低预期

Ripple 与美国 SEC 长达数年的诉讼再度出现进展。在 8 月 7 日提交给纽约南区美国地方法院的一份文件中,法官 Analisa Torres 裁定 Ripple 应承担超过 1.25 亿美元的赔偿责任,罚款要在 30 天内向 SEC 支付;此外发布禁令文件,禁止 Ripple 进一步违反证券法,如果 Ripple 计划出售任何证券,则必须提交一份注册声明。

关于防止 Ripple 未来违反证券法的禁令,Torres 法官表示,该公司在美国 SEC 提起投诉后进行的销售可能没有违反联邦法律,但「未来违反法律的可能性很大,值得发布禁令」。

法官 Torres 的裁决对双方来说都是喜忧参半。虽然法院认定某些 XRP 销售确实构成证券发行,但它也裁定 XRP 本身不是一种证券。这对 Ripple 来说是一次「重大胜利」,并已在加密货币市场引起轩然大波,XRP 的价格也随之大幅飙升。Coingecko 数据显示,XRP 24 小时涨幅达 19.2%。

「Ripple 宣布获胜」

因金额远低于 SEC 要求的 10 亿美元非法所得和判决前利息以及 9 亿美元的民事罚款。首席执行官 Brad Garlinghouse 在 X 平台表示,鉴于法院将 SEC 提出的罚款减少了 94%,这项裁决是「Ripple、行业和法治的胜利」。

Ripple 首席法律官 Stuart Alderotyz 表示,公司将「尊重 1.25 亿美元的罚款」。「最终判决。法院驳回了 SEC 提出的 Ripple 鲁莽行事的建议,并提醒 SEC,此案不涉及任何欺诈或故意不当行为的指控,也没有人遭受任何经济损失。她拒绝了 SEC 提出的 20 亿美元罚款和罚金的荒谬要求。我们尊重法院判决的 1.25 亿美元罚款。」

诉讼并未彻底结束

2020 年,美国 SEC 指责 Ripple 通过出售 XRP 筹集了 13 亿美元,称 XRP 是一种未注册的证券。

2023 年 7 月,法官裁定 Ripple 直接向机构客户出售 XRP 违反了联邦证券法,但通过交易所向散户程序化出售 XRP 的行为没有违反任何证券法。在案件审理期间,SEC 曾试图对该部分裁决提出上诉,但未能成功。

Ripple 连续第四次战胜 SEC,似乎宣告着 Ripple「重见光明」,但诉讼阴霾并未彻底消散。SEC 在未来的 60 天内,仍可能对该裁决提出上诉,这意味着围绕 XRP 的法律纠纷可能会再度持续。但此次胜诉无疑提振了 Ripple 的信心,有助于一改当下委靡的市场。

Demand is bifurcating into high-core-count CPUs for in-rack GPU support and moderate-core CPUs for standalone Agent task orchestration. In China, this global trend presents an opportunity for domestic CPU manufacturers like Hygon (海光信息) and Huawei Kunpeng, who are bolstered by both growing AI infrastructure needs and national policies promoting technological self-reliance ("xin chuang"). The maturity of their software ecosystems is also accelerating, evidenced by faster adaptation to new AI models. In conclusion, the narrative is shifting from a GPU-centric view to one where CPU-GPU synergy is critical. The CPU is no longer a peripheral component but a performance-defining bottleneck and a key growth driver in the AI hardware stack, opening a massive new market estimated in the hundreds of billions of dollars.
