The Senate leaves town in two weeks. Here's what needs to happen for Clarity to advance before then.

Senators released new text for the Clarity Act, merging two versions and addressing for the first time what an ethics provision might look like. The bill isn't yet at the finish line though.

The narrative

We have a new draft of the Digital Asset Market Clarity Act, which merges the drafts advanced by the Senate Banking and Agriculture Committees. It also adds an ethics provision that would bar senior government officials from sponsoring or issuing their own cryptocurrencies in response to President Donald Trump.
The window for passage is tightening, and while a new draft is progress, the fact that we're still waiting to see if there's bipartisan agreement on a key provision means the timeline is getting very tight indeed.

While we have new text and it does have an ethics provision, the underlying dynamics of the debate don't seem to have changed very much. The key thing to note here is that while this is a crypto bill that will result in sweeping changes to how federal regulators and their jurisdictions are defined, the biggest outstanding issue doesn't really have a lot to do with that.

Democrats want a more binding ethics provision, one that will let them actually affect Trump and the $1.4 billion he made off crypto last year, while Trump and Republicans don't want that to happen.

Can Bitcoin Miners Become Part Of The Payment Stack?Bitcoin began as peer-to-peer electronic cash, but the market gave it a different job. Over the past decade, Bitcoin has become crypto's benchmark investment asset: something to accumulate, custody, borrow against, and measure against. Stablecoins, meanwhile, became the industry's practical payment rail.

That split made sense. Bitcoin's volatility, confirmation times, and tax complexity made it awkward for everyday spending, while stablecoins offered the thing merchants and users actually needed: a familiar unit of account that could move quickly across digital rails. Bitcoin became the asset people did not want to spend. Stablecoins became the money they could.

The gap is becoming more visible as stablecoins move deeper into mainstream payment infrastructure. Visa said its stablecoin settlement pilot now supports nine blockchains and had reached a $7 billion annualized settlement run rate as of March 2026. That does not mean stablecoins have solved every payments problem, but it does show which part of crypto is being absorbed most quickly into commercial finance.

Bitcoin is now facing the opposite question. It does not need to prove that it can be held. It needs to prove that it can move in ways that create useful economic activity. More specifically, it raises a question for the companies that secure the network: can miners evolve from passive validators into active participants in Bitcoin's payment economy?
