Financial giant Franklin Templeton, a subsidiary of Franklin Resources Inc. (NYSE: BEN), announced its endorsement of the CLARITY Act on July 27 after reporting $1.79 trillion in assets under management as of June 30.

The firm indicated that the CLARITY Act would establish clearer rules for digital assets, helping investors better understand the protections available to them while giving companies greater certainty over which federal regulators oversee their operations. Franklin Templeton added that the legislation would provide the regulatory clarity the crypto industry has long sought.

New CLARITY language would shield dormant self-custodied Bitcoin from state lost-property claims based on inactivity alone.
CLARITY draft Section 20216 would stop self-custodied Bitcoin from becoming abandoned or forfeited because a wallet stayed inactive.

02That would block state lost-property claims that rely on years of silence to transfer dormant coins to finders or the government.

03The provision still leaves courts to decide whether notice campaigns, police reports, or other evidence outweigh inactivity alone.
Section 20216 of the latest CLARITY draft states that a self-custodied digital asset cannot become abandoned, unclaimed, or forfeited. It also cannot become subject to adverse possession or finder's title solely because its owner has not moved it or otherwise shown continued interest.

The language overrides state and local laws that treat years of wallet inactivity alone as grounds for transferring ownership to someone else.

The May 8 and May 20 Senate drafts protected only the ability to hold a self-hosted wallet, and the July 22 version adds scope beyond that, extending into property law and covering whether a person still owns the coins inside that wallet once years of silence go by.

The section defines a self-custodied digital asset as one where the owner keeps exclusive control of the private keys without relying on a custodian, exchange or intermediary.
