The South African Revenue Service (SARS) has released draft tax guidance explaining how existing income tax and capital gains tax laws should apply to crypto assets. Rather than introducing new taxes, the proposal aims to clarify how current legislation applies to digital assets and seeks public feedback before the guidance becomes final.

According to the draft, most cryptocurrency activities—including buying and selling, exchanging one crypto asset for another, and using crypto to pay for goods or services—may be considered taxable disposal events. Whether tax is owed will depend on the specific facts of each case, including the nature of the transaction and the taxpayer's overall investment behavior.

SARS has reaffirmed that cryptocurrencies are not recognized as legal tender or foreign currency under South African law. Instead, they are classified as intangible assets. This distinction means crypto transactions fall under existing asset taxation rules rather than currency exchange regulations.

A key element of the proposed guidance is the taxpayer's intention. Authorities will assess whether an individual acquired crypto for long-term investment or active trading.
