CFTC fires back after Kentucky targets Polymarket, Kalshi
The Commodity Futures Trading Commission has sued Kentucky in federal court, seeking to stop the state from enforcing gaming laws against federally regulated prediction market operators.

The case names Kentucky Governor Andrew Beshear, Attorney General Russell Coleman, Department of Revenue Commissioner Thomas B. Miller, and the Kentucky Horse Racing and Gaming Corporation as defendants.

The CFTC says Kentucky’s actions conflict with the Commodity Exchange Act, which gives the regulator authority over futures, options, and swaps traded on federally regulated exchanges.

“Kentucky is the latest state attempting to shut down federally-regulated event contracts,” said CFTC Chair Michael Selig.

The agency asked the court for declaratory and injunctive relief. Kentucky says sports-linked contracts need state oversight.

State action targets platforms

Kentucky sued Kalshi, Polymarket, and partners tied to Coinbase, Robinhood, and Webull on June 17. The state said the companies offered sports event contracts without a Kentucky gaming license and without following state rules. It also argued that the products fall under the state’s definition of sports wagering.

The CFTC rejected that view in its complaint. It said Kalshi and Polymarket are designated contract markets under federal oversight. It also said Coinbase, Robinhood, and Webull are registered futures commission merchants that can offer event contracts through partnerships with regulated exchanges.

Moreover, the regulator described the targeted contracts as swaps under federal commodities law.

Spot market data revealed a different story beneath the decline. At the time of writing, Spot Taker CVD remained firmly positive and continued trending higher even as $PENDLE moved lower. This divergence suggested that aggressive buyers continued entering the market through market orders.

However, their activity failed to translate into immediate price appreciation. Instead, sellers appeared to absorb incoming demand and prevented buyers from regaining control. This imbalance highlighted a market where participation remained healthy but directional conviction remained split.

Demand for bearish $ETH positioning briefly surged on Tuesday as the perpetual futures annualized funding rate flipped into deeply negative territory, meaning shorts (sellers) paid to keep their positions open. The current 3% level signals a lack of confidence from bulls, but it should not come as a surprise given Ether’s recent weakness.

Ether price declined by 20% over 30 days, slightly worse than the 17% drop in the broader cryptocurrency market capitalization. Part of the move ties to investors’ fear over ongoing peace negotiations between the US and Iran. Moreover, high costs of artificial intelligence build-out have led investors to act more cautiously.

The overall weakness in the decentralized applications (DApps) industry has led multiple projects to shut down, while the aggregate total value locked (TVL) shrank by 23% in three months. CBOE eyes crypto perpetuals as Kalshi upends futures marketCBOE has begun evaluating a conversion of its Bitcoin and Ether futures into perpetual contracts after crypto perpetuals generated more than $8.5 billion in trading volume on Kalshi within weeks of launch.

According to a June 23 report from The Wall Street Journal, CBOE Global Markets is considering turning its continuous Bitcoin and Ether futures into perpetual futures following recent regulatory developments in the United States.

The report cited Rob Hocking, CBOE's global head of derivatives, who said the exchange is exploring the possibility after the U.S. Commodity Futures Trading Commission approved cryptocurrency perpetual futures for prediction market operator Kalshi.

While Hocking did not provide a timeline for any changes, the comments place one of the largest U.S. exchange operators among a growing list of firms responding to fresh competition in the perpetual futures market.

CBOE introduced its continuous Bitcoin and Ether futures contracts in December, offering products with expirations extending as far as 10 years.

According to The Wall Street Journal, the exchange is now studying whether perpetual contracts could provide an alternative structure following the CFTC's decision to permit similar products on regulated U.S. venues.
