Judge Stanley Blumenfeld Jr. determined that the token does not meet the criteria of an investment contract, invalidating claims of unregistered securities.

The lead plaintiff, Lee Greenfield, reported losses exceeding $40,000 after investing in the Solana and Ethereum versions of the asset.

The ruling concludes that there was no “common enterprise” according to the Howey Test, exempting Jenner from federal securities fraud allegations.

On Friday, a district judge in California issued a landmark ruling by decreeing that Caitlyn Jenner’s JENNER cryptocurrency does not constitute a financial security. The decision follows a class-action lawsuit accusing the celebrity of promoting unregulated assets.

The court analyzed the case under the Howey Test, a legal tool that defines whether an asset is an investment contract. The judge concluded that there was no “common enterprise” or technical capital pooling mechanisms to justify the classification.

Despite the plaintiff’s argument that Jenner’s fame influenced the expectation of profits, the ruling maintains that investors did not share profits or losses collectively. This technical nuance is crucial for differentiating memecoins from traditional stocks.

The defense for Jenner and her late manager, Sophia Hutchins, always maintained that the Ethereum-based token lacked the characteristics of a security. The court finally validated this stance, pointing out deficiencies in the prosecution’s arguments.

Quantum computing has long served as Bitcoin’s most cinematic threat. It has the right ingredients for a high-drama warning, strange machines, broken cryptography, and the possibility of a future rewrite of digital trust.

Yet the greater danger facing Bitcoin today looks far more ordinary and far more commercial. It is artificial intelligence, and the pressure point is electricity.

That pressure is already visible. As of today, Bitcoin is trading at $77,845 on CryptoSlate, up 5% over 24 hours, 6.7% over seven days, and 9.2% over 30 days.

Price has recovered over the past month, but the mining side of the network is still operating under tighter economics than the market’s casual surface suggests.

In its Q1 2026 mining report, CoinShares said the weighted average cash cost to produce one Bitcoin among publicly listed miners rose to about $79,995 in Q4 2025. The same report said the current hashprice around $30 per petahash per day leaves an estimated 15% to 20% of the global fleet underwater if power costs are high enough.

That is where AI enters the picture with a much sharper edge than quantum. Quantum remains a serious long-term cryptographic issue. NIST has already finalized its first post-quantum standards because the migration clock is real, and IBM’s roadmap targets the first large-scale fault-tolerant quantum computer by 2029.

The earlier rally followed a well-formed higher low on the daily chart. After a higher high of $43.77 on March 18, HYPE started to pull back. It retested prior higher highs and eventually found support around $35 on April 2.

Afterward, HYPE resumed an uptrend from the higher low at $34.47, targeting an upward push. This time, it had a golden cross as further fuel for the rally. This bullish crossover happened between the 200-day and 50-day moving averages on April 6. The latter crossed over the former, signaling that bearish momentum has exhausted.

The price expansion continued, pushing HYPE past its former higher high of $45.77 yesterday before the current consolidation started. With no clear resistance around this area, analysts expect a further push higher.
