So, when the SEC delayed its plan to allow tokenized U.S. stocks last week, my first reaction was relief, not frustration. Michael Burry, the investor who called the 2008 crisis, immediately warned that the plan could trigger a systemic disaster. He's right, but not for the reasons most people think.

The problem isn’t tokenization itself. It’s that we’re about to tokenize the world’s most liquid markets with legacy compliance systems that aren’t built for real-time execution. Currently, there is always a lag of one to two days between when a trade is executed and when it is fully settled. As we move towards real-time execution, we need compliance systems that evaluate trades in real time, especially if they are intended to support the transfer of tokenized U.S. equities.

The CLARITY Act is a United States market-structure bill, and most coverage treats it as a domestic fight over which agency regulates which token. That framing misses the larger consequence.



If the bill clears the Senate floor and reaches President Trump’s desk, its effects will not stop at the American coastline. A company in Singapore, an exchange in the Cayman Islands, and a token team in Lisbon will all change how they operate because of a law passed in Washington.

This is how financial rules from a large market travel. They do not require treaties or foreign adoption.



They spread because the market is too big to ignore and the currency at the center is too important to route around. The CLARITY Act, paired with the stablecoin law that already passed, would push American definitions of what a crypto asset is and how it must be handled into jurisdictions that had no vote on either one.

Three of the largest U.S. crypto advocacy organizations have urged Congress to pass legislation that would allow digital asset miners and stakers to defer taxation on newly created tokens until those assets are sold.

In a joint letter sent to the House Ways and Means Committee, the Blockchain Association, Crypto Council for Innovation and The Digital Chamber voiced support for H.R. 9175, the Tax Clarity for Mining and Staking Act, and called on lawmakers to approve the bill as introduced.

The groups described the proposal as a “balanced compromise” that would address years of uncertainty surrounding the taxation of mining and staking rewards while preserving eventual income recognition.
Representative Mike Carey introduced the legislation. It would establish a new framework for taxing newly minted digital assets received through mining and staking activities.

Under current IRS guidance, miners and stakers generally recognize taxable income when rewards are received. The proposed bill would preserve that treatment as the default option. 

However, it would also allow taxpayers an alternative approach that defers income recognition until the assets are disposed of.

If a taxpayer makes that election, newly minted digital assets would not be included in gross income when received. Instead, gains would be recognized when the assets are sold or otherwise disposed of.

Supporters argue that the approach addresses concerns that taxpayers can face tax liabilities before they have converted rewards into cash.
