SEC weighs new rulemaking for onchain market structures and software applications
Software applications don’t fit neatly into the SEC’s regulatory roles, such as a clearing agency, broker or exchange, said SEC Chair Paul Atkins said on Friday.

The remarks underscore the SEC’s increasingly crypto-friendly posture under Atkins compared with former Chair Gary Gensler, who took a more cautious approach to digital assets.

Industry groups praised the remarks on Friday.
The Securities and Exchange Commission needs to make clear how its longstanding regulatory framework applies to software applications as the agency considers writing future rules for onchain financial markets, said its Chair, Paul Atkins.

Software applications don't fit neatly into the SEC's regulatory roles, such as a clearing agency, broker or exchange, Atkins said on Friday at an artificial intelligence expo hosted by the Special Competitive Studies Project.

"Software applications today do not always organize themselves neatly along these categorical lines," Atkins added. "A single protocol can execute a trade, manage collateral, route liquidity, execute trading strategies through vault structures, and settle the transaction—all within a unified, automated system, often within seconds."

The remarks underscore the SEC’s increasingly crypto-friendly posture under Atkins compared with former Chair Gary Gensler, who took a more cautious approach to digital assets and argued that most cryptocurrencies fell under the agency’s jurisdiction.

Since taking office, Atkins has floated the idea of an innovation exemption for tokenized securities and overseen the release of a taxonomy aimed at clarifying which digital assets may qualify as securities.

He argued that while the SEC intends to “future-proof” its efforts through notice-and-comment rulemaking, there is “no more powerful” future-proofing mechanism than enshrining well-designed statutory language in law.

The Hyperliquid Policy Center, led by Jake Chervinsky, said it was encouraged by Atkins’ approach of mapping on-chain clearing and settlement systems to existing legal frameworks “on their own terms,” rather than forcing them into legacy categories built for legacy architecture.

The Hyperliquid Policy Center also called on-chain clearing and settlement “one of the most significant financial infrastructure innovations of our generation,” and it said it views the chairman’s stance as a constructive step toward regulatory alignment as on-chain systems continue to evolve.

At the time of writing, the Hyperliquid platform’s native token, $HYPE, was trading at $42.98, marking a 2% increase over the last 24 hours. Currently, the Hyperliquid token is trading at almost 27% below its all-time high of $59, which was reached last year.

Early 2026 surveys from Coinbase and EY-Parthenon showed 73% of institutional decision-makers planned to increase crypto allocations this year.However, most institutions still maintain cautious exposure levels near 1% to 2% of assets under management. This hesitation largely reflects unresolved compliance uncertainty despite growing demand for regulated crypto access.

Meanwhile, U.S. Spot Bitcoin ETFs accumulated more than $100 billion in assets under management, while institutional ownership climbed toward 24% to 27%. These flows reinforced how institutions increasingly prefer regulated vehicles over direct token exposure.

As compliance pathways improve, pension funds, family offices, and endowments may gradually shift crypto from tactical exposure toward broader portfolio integration.

Crypto markets felt the impact immediately
Bitcoin dropped below $80,000 within minutes of the release, then recovered to around $80,200 as traders recalibrated. Total liquidations over the 24-hour period surrounding the report exceeded $341 million. Options expirations in Bitcoin and Ethereum were projected to exceed $2 billion, adding another layer of volatility to an already jittery session.

What the Fed is watching
The headline number of 115,000 jobs screams resilience, and probabilities for near-term Federal Reserve rate cuts declined after the data hit. But a 0.2% monthly gain in average hourly earnings, below the 0.3% consensus, suggests that the labor market’s tightness isn’t translating into runaway wage inflation.

Initial jobless claims for the week ending April 16 came in at 207,000, below the expected 215,000. Consumer sentiment, meanwhile, declined, and inflation expectations eased.

What this means for investors
Higher Treasury yields and a firmer US dollar are the typical byproducts of better-than-expected employment data, and both historically act as headwinds for digital assets. The $341 million in liquidations is evidence that this reallocation happens fast and without much warning.
