华尔街上演 "螳螂捕蝉,黄雀在后"
在SEC的雷霆行动之下,当加密市场还沉浸在恐慌之中时,华尔街反而大举入场,再次上演“别人恐慌我贪婪”的戏码。
6月15日,资管巨头贝莱德向SEC提交比特币ETF申请;6月19日,Arch Public联合创始人Andrew Parish透露,全球第三大资产管理公司富达疑似正在考虑收购Grayscale或申请比特币现货ETF;6月20日,由城堡证券(Citadel Securities)、富达投资(Fidelity Investments)和嘉信理财(Charles Schwab)等支持的新加密货币交易所EDX Markets宣布上线;6月22日,彭博高级ETF分析师Eric Balchunas发推称,资产管理巨头Invesco(景顺)也重新提交了现货比特币申请;6月23日,SEC批准Volatility Shares的2倍比特币策略ETF(BITX)生效,成为美国第一只杠杆加密货币允许ETF。
值得注意的是,贝莱德申请的比特币ETF市场中很多人认为像信托产品,因为它没有 ETF 所具备的每日赎回机制,它将以每篮 40, 000 枚比特币的形式从该信托中添加和赎回,这会使得它产生与 Grayscale Bitcoin 信托基金类似的资产净值溢价和折价问题。但是,贝莱德申请的这类ETF更像是 GLD 和贝莱德旗下安硕(iShares)管理的多支知名 ETF 基金,和 Grayscale 发行的 GBTC 这类信托基金相比,它更加灵活,可供赎回。市场预测,贝莱德不会做无准备之事,而且这种另类ETF的设计通过概率也确实更大。如果贝莱德申请的ETF通过,这意味着加密市场离比特币现货ETF就更近一步,几乎就是层窗户纸了。

西边不亮东边亮,港府正承接美国加密金融产业
在美国SEC对加密市场进行强力打压的时候,香港这座东方明珠对加密市场展开怀抱;当美国银行禁止给加密交易所等开设银行账户时,香港正在全力推动当地银行接纳加密客户。加密金融的东西方转移趋势正在变得越发明显。整体上看,这也是加密市场对于SEC的担忧正在快速消减的原因,这也成为刺激加密行情复苏的主要宏观原因。
港区政府将加密金融事项作为重点所在,并打算引领潮流。据《比推》报道,6月23日,香港财政司司长陈茂波接受《大公报》专访时表示,如何将虚拟资产服务提供者纳入合适规管,保护投资者利益,同时又保持金融稳定和安全,是特区政府的重点所在。Gemini联合创始人在6月23日表示,已与香港证监会碰面,香港已准备好在加密货币领域引领潮流。
越来越多加密交易所等正在向香港转移。据《比推》报道,6月21日,Deribit亚太地区负责人Lin发推称,渣打银行已经给香港的某家交易所开户成功,可以直接在银行里进行客户出入金和交易清结算。6月26日,香港最大银行汇丰银行于今日允许其客户买卖香港交易所上市的虚拟资产ETF,也是香港第一家允许客户买卖港交所上市虚拟资产ETF的银行。美国稳定币发行商Circle也在关注香港,Circle联合创始人兼首席执行官Jeremy Allaire称:“香港显然正在寻求将自己打造成非常重要的数字资产市场和稳定币中心,我们正在密切关注这一点,亚洲和新兴市场对美元稳定币的巨大需求。”

加密监管2.0 将至,下拨大红利在于机构入场
正如上文所言,目前香港的加密金融监管整体越来越清晰,美国目前似乎正在加大对加密行业的打击;但从长远的角度看,美国SEC的诉讼势必将有助于推进加密金融监管政策的落地。而一旦美国加密政策明确,机构入场势必将推动一轮巨大的牛市。
我们此前在《加密“风浪”之下,投资者该如何避险?》一文中曾提出这样一个观点:从中长期来看,美SEC最近发起的诉讼案最终有可能加快美国针对加密市场的监管立法。除了币安,美SEC还对Coinbase进行诉讼,Coinbase是美国上市公司,在美国拥有大量用户,对这家交易所的起诉可能会刺激国会在加密货币监管方面采取积极行动。市场各方呼吁之声越发强烈。美国立法机构陆续也注意到事态严重性,陆续开始召开听证会,这也可以视为为立法工作提供一些准备工作。据《比推》报道,美国众议院金融服务委员会主席Patrick McHenry宣布将于美国东部时间6月13日14:00(北京时间6月14日2:00)召开主题为“数字资产的未来:为数字资产生态系统提供清晰度”的听证会。
另外,英美属于判例法系,注重法典的延续性,以传统、判例和习惯为判案依据。加密金融行业作为一个崭新的行业,没有之前判例可循,所以此次SEC和币安、Coinbase的诉讼会成为非常具有典型性的案件,这无疑也是未来美国监管走向明晰的标志性事件。针对美SEC的起诉书,华尔街巨头反应也是非常迅速,既然SEC认为大多数POS类代币都是证券,那么就避开这些等等,所以主要上线比特币等PoW类代币。整体上看,伴随加密监管明确,机构投资者很大概率将在下一轮牛市中成为推动加密金融走向繁荣的核心力量。

整体上,加密市场监管明确性大概率会在下轮牛市中确定下来,目前不论东方还是西方,其实质上都还处于一个探索阶段,毕竟加密资产等等都是新事物,这必须经过一场大论战,以及很多积极尝试,最后才能成为法律。只有这样,比特币等才能为更多人接受,才能真正的融入到传统金融,并深远地影响加密金融。
