The U.S. Ninth Circuit Court of Appeals has ruled against Kalshi's request for an administrative stay, clearing the way for Nevada regulators to pursue a temporary restraining order. Analysts suggest that if the ban is implemented, Kalshi could be forced to withdraw entirely from the Nevada market for at least two weeks.

Previously, the Nevada Gaming Control Board issued a cease and desist order to Kalshi in March 2025, demanding it stop offering prediction contracts related to sports. Kalshi warned that a subsequent temporary restraining order sought by the state could be expanded to prohibit all of its event contracts.

In its appeal on March 13, Kalshi stated that without a stay, it would face "imminent harm" and potentially engage in litigation in state, federal, and multiple appellate courts regarding "state regulatory jurisdiction," risking conflicting rulings.

Currently, prediction market platforms, including Kalshi, are facing regulatory pressure from multiple states across the U.S. The U.S. Commodity Futures Trading Commission (CFTC) asserts exclusive regulatory authority over prediction markets and has submitted opinions in relevant federal cases supporting this position.
