On March 22, the U.S. Commodity Futures Trading Commission (CFTC) further detailed its requirements for the use of crypto assets as collateral, building on a pilot program launched last year. In a notice released on Friday, the CFTC's Market Participants Division and Division of Clearing and Risk responded to frequently asked questions arising from two staff letters issued in December of last year. These letters established a pilot program to permit the use of crypto assets as collateral in derivatives markets.

The notice reminded futures commission merchants (FCMs) wishing to participate in the pilot that they must submit a notification to the Market Participants Division, "indicating the date on which they will begin accepting customers' crypto assets as margin collateral." The crypto industry believes that blockchain technology is best suited for 24/7 trading and instant settlement. In its December guidance, the CFTC clarified which tokenized assets could be used as collateral and how they would be valued to determine the amount of collateral required for trading positions.

The U.S. CFTC explicitly stated that its regulatory guidance will be consistent with the U.S. Securities and Exchange Commission (SEC), as both agencies are jointly developing a regulatory framework for cryptocurrencies. The CFTC noted that capital requirements to cover losses will be "consistent" with the SEC: futures commission merchants will be required to maintain a 20% capital requirement for BTC and ETH positions, while stablecoins will be subject to a 2% capital requirement.

The notice also added that FCMs participating in the pilot will only be permitted to accept BTC, ETH, or stablecoins as collateral during the initial three-month period and must promptly report any significant cybersecurity or system issues. Additionally, these institutions will be required to submit weekly reports disclosing the total amount of crypto assets held across various customer accounts.

After the three-month pilot period concludes, other crypto assets will be permitted as collateral, and the aforementioned periodic reporting requirements will be rescinded.
