Fairshake, a PAC funded by crypto companies, and two of its affiliates reported $7.2 million in media spending this week alone, targeting congressional races in Georgia, Alabama, Nebraska, Kentucky, and Texas.

The money came through two separate arms: Protect Progress, which backs Democratic candidates, and Defend American Jobs, which supports Republicans. Together, they reflect a deliberate effort to build influence on both sides of the aisle.

The numbers behind Fairshake are hard to ignore. According to federal filings, the group held more than $190 million as of January. In the 2024 election cycle, its affiliates burned through more than $130 million on political advertising.

That spending is widely credited with shifting the composition of the current Congress — the same body now weighing crypto legislation.
Kentucky Republican Andy Barr pulled in the largest single chunk of this week’s spending. Defend American Jobs directed more than $3.5 million in media support toward his US Senate campaign.


Barr has been a consistent advocate for crypto-friendly policy in Congress, voting in favor of both the GENIUS Act and the CLARITY Act.

The recovery had been building momentum — and today that momentum met a specific kind of obstacle that XWIN Research Japan has analyzed in detail, with findings that change how the decline should be read.

Bitcoin briefly fell below $80,000 today. Ethereum dropped under $2,300. More than $90 billion was erased from the combined crypto market cap from recent highs, with approximately $331 million in liquidations over the past 24 hours — nearly $100 million of that occurring within a single two-hour window. The speed and scale of the move created the kind of alarm that typically accompanies a macro shock.

But the macro environment did not produce this decline. The S&P 500 and NASDAQ remained near record highs throughout the same period. Traditional equities did not sell off. Risk appetite in broader markets did not deteriorate. The forces that drove Bitcoin below $80,000 were not external.

According to XWIN Research Japan, the decline was driven primarily by internal crypto market structure — specifically the combination of leverage positioning that had accumulated during the recovery and profit realization from holders who had returned to profitability after weeks of recovery. The market did not break because of what was happening outside it. It broke because of what had been building inside it.

Where this fits in the broader AI agenda

The planned security order would layer on top of a growing stack of AI-related executive actions from the Trump White House. On January 23, 2025, the president signed Executive Order 14179, which was squarely focused on removing barriers to American AI leadership.

Then on December 11, 2025, a second executive order titled “Ensuring A National Policy Framework for Artificial Intelligence” pushed the strategy further. It directed the formation of an AI Litigation Task Force and tasked the Secretary of Commerce with reviewing state-level AI laws by March 11, 2026.

The December order also handed David Sacks, the administration’s AI and crypto czar, and Michael Kratsios a specific job: draft a federal AI framework designed to preempt the patchwork of state regulations popping up across the country. The FCC Chairman was given 90 days to begin proceedings on federal AI model reporting standards.

What the judge actually ruled
The SEC sued Ripple in December 2020, alleging the company sold $XRP as an unregistered security, raising $1.3 billion through those sales.

In July 2023, Judge Analisa Torres delivered a split decision. She found that Ripple’s institutional sales of $XRP did qualify as securities transactions. But programmatic sales of $XRP on public exchanges were not securities.

The SEC initially signaled it would appeal the ruling. Then, in March 2025, the agency dropped the appeal entirely. $XRP surged 10% to $2.55 on that news.

Garlinghouse’s take
During an interview on Fox Business, Garlinghouse called the ruling “brilliant” and declared the saga complete.

“I’m finally able to announce that this case is over. It’s over.”

Garlinghouse highlighted $XRP’s growing institutional use case, suggesting that banks and financial institutions are more willing to adopt assets that come with legal clarity.

The SEC did not immediately comment following the announcement. The court docket also remained unupdated after Garlinghouse’s public statements.

Why this matters beyond $XRP
One risk to monitor: the same ruling that freed programmatic $XRP sales also confirmed that institutional sales were securities violations. Ripple paid a $125M penalty as part of the resolution.

The asset was trading at $1.3849 as of late February 2026 according to MEXC data, well off the $2.55 high it hit when the SEC dropped its appeal.
