Senate Schedules CLARITY Act Markup as Banking Lobby, Democrats Mount Resistance

After nearly a year of delays, the Senate Banking Committee scheduled a markup of the CLARITY Act for May 14.
The Senate Banking Committee has set May 14 as the date for its long-delayed markup of the Digital Asset Market Clarity Act, the most consequential piece of cryptocurrency legislation ever to reach this stage in Congress, as a last-minute lobbying blitz from major banks and a Democratic ethics standoff threaten to derail the bill before it clears committee.

The executive session is scheduled for 10:30 a.m. at Room 538 of the Dirksen Senate Office Building in Washington, D.C., where committee members will debate amendments and vote on whether to advance the legislation to the full Senate floor. Committee Chairman Tim Scott (R-SC) confirmed the date last week, and live video feed of the proceedings will be available to the public.

The CLARITY Act — formally H.R. 3633, the Digital Asset Market Clarity Act of 2025 — passed the House of Representatives on July 17, 2025, by a 294–134 bipartisan vote, with all 216 Republicans in support and 78 Democrats crossing the aisle. Since then, the bill has stalled in the Senate through two cancelled markup sessions, extended negotiations over stablecoin regulation, and an intensifying lobbying fight between the crypto industry and the traditional banking sector.

At its core, the legislation would draw a regulatory boundary between the Securities and Exchange Commission and the Commodity Futures Trading Commission, settling years of jurisdictional litigation over whether digital assets are securities or commodities.

The social media post came alongside a chart showing Strategy, formerly known as Microstrategy, holding 818,334 $BTC valued at approximately $66.15 billion. The company’s average purchase cost sits near $75,537 per coin, with an unrealized gain of 7.02%.

One week earlier, on May 3, Saylor posted the inverse message: “No buys this week. Back to work next week. $BTC.” That pause marked the second break in Strategy’s near-weekly purchase streak in 2026 and coincided with the company’s quiet period ahead of its Q1 2026 earnings release on May 5.

Public companies typically avoid large capital transactions before an earnings call to comply with financial regulations and prevent any appearance of selective disclosure. For Strategy, that timing made a temporary halt in bitcoin purchases routine procedure.

Sunday’s post effectively flips the switch back to accumulation mode. Saylor’s phrase “back to work” and other cryptic hints have become a recognizable signal for markets and followers: the quiet period has ended, and purchase disclosures are expected in the next 24 hours. Typically, Strategy and Saylor announce such matters at 8 a.m. on Monday mornings.

Before the pause, Strategy had been accumulating at a rapid pace, adding tens of thousands of $BTC throughout April, funded through its preferred stock instrument STRC. During the Q1 earnings call, Saylor addressed the instrument directly. Strategy’s STRC Series A Perpetual Stretch Preferred Stock carries an annual dividend yield of approximately 11.5%.

Bitcoin’s premium on South Korean exchanges climbed to 1.98% on May 7. That’s the highest it’s been since late February. At the same time, onchain data shows holders are cashing out their biggest daily profits in five months, with $BTC trading above $80,000.

Bitcoin’s Kimchi Premium is tracked by CryptoQuant’s Korea Premium Index (KPI). It measures the price gap between Bitcoin on South Korean exchanges and the global volume-weighted average.

The 2% reading is a sharp turnaround from early March, when the index had dropped to a 2.27% discount after the U.S.-Iran conflict kicked off.

Strict controls on funds and KYC checks on residency are in place in South Korea. There is almost no way to do $BTC arbitrage. The CryptoQuant KPI is used to measure real-time differences in demand between one place and another.

The premium jumps when Korean buyers buy more Bitcoin. But if they sell, the KPI can go down.

The swing from discount to premium wasn’t clean. CryptoQuant data shows the KPI bounced around throughout March.

Most of the month saw pronounced discounts before a brief recovery around March 27 and 28, tacked on about a percentage point. April stayed mostly positive, with some scattered dips.

The May 7 reading of 1.98% was the first time the index got close to 2% since the day before the U.S.-Iran conflict.

The premium had already cooled to 0.77% when measured against Upbit’s $BTC price and current global VWAP figures.
