U.S. regulators are starting to lay out clearer rules for how crypto can be used in traditional financial markets.
On Friday, staff at the Commodity Futures Trading Commission (CFTC) released a new FAQ explaining how futures brokers and clearinghouses should handle digital assets used as collateral in derivatives trading. The guidance is meant to remove confusion and make it easier for firms to operate under existing rules.
The FAQ builds on earlier guidance issued in December 2025, which introduced a pilot program allowing certain cryptocurrencies—like bitcoin, ether, and the stablecoin USDC—to be used as collateral in derivatives markets.
One of the biggest takeaways is how the CFTC wants firms to manage risk. The agency is aligning its approach with the Securities and Exchange Commission (SEC), setting standard “haircuts” (risk discounts) on crypto assets:
Bitcoin and ether will carry a 20% capital charge
Payment stablecoins will have a much lower 2% charge
This means firms must hold more capital against volatile assets like bitcoin and ether, while stablecoins—considered less risky—require far less.
There are also limits on how firms can use these assets. Futures commission merchants (FCMs) are allowed to deposit their own stablecoins into customer accounts as part of required funds. However, they cannot do the same with more volatile cryptocurrencies like bitcoin or ether.
Overall, the message from regulators is clear: crypto can play a role in traditional derivatives markets, but only within a structured and risk-controlled framework.
By aligning rules between the CFTC and SEC, regulators are also trying to create consistency across the financial system—something the industry has been pushing for as it continues to integrate digital assets into mainstream finance.
