Совет управляющих ФРС и подконтрольная Минфину Сеть по борьбе с финансовыми преступлениями (FinCEN) выступили с поправками в Закон о банковской тайне, расширяющей определение термина «деньги».

«ФРС и FinCEN предполагают, что расширенное определение термина обеспечит применение правил к внутренним и трансграничным транзакциям с использованием конвертируемой виртуальной валюты. Эта валюта является средством обмена, имеет эквивалентную стоимость в национальной валюте или выступающим в качестве заменителя нацвалюты независимо от наличия статуса законного платежного средства», — говорится в комментариях к законопроекту.

После пересмотра значения термина «деньги» федеральные органы надзора рассчитывают получить возможность предъявлять новые требования к отчетности финансовых учреждений — как по внутренним, так и трансграничным криптовалютным транзакциям. Начало действия поправок, если их одобрит Конгресс, запланировано на сентябрь 2025 года.

Ранее ФРС США обвинила Customers Bank в ненадлежащем контроле деятельности, связанной с инвестициями в виртуальные цифровые активы, и потребовала ограничить риски обслуживания клиентов.
