Prediction markets get tailored U.S. guidance from former foe CFTC

Prediction market firms such as Polymarket and Kalshi have a new set of guidelines for U.S. operation, with the Commodity Futures Trading Commission laying out initial guidance and a proposed permanent rule Thursday for what the agency called "a proven source of reliable information for news media, sports leagues, financial institutions, and everyday Americans."

The agency had once been a legal adversary of the prediction markets, warning that certain betting ran afoul of derivatives laws and that the CFTC couldn't function as a global policy force combating fraud and manipulation in political markets all over the world. But under Chairman Mike Selig, the CFTC abandoned its old legal fight and embraced the firms. It's now issued a non-binding staff advisory to the prediction market firms regulated by the CFTC as "designated contract markets," and started a binding rule process.

"This begins the process of new rulemaking grounded in a rational and coherent interpretation of the Commodity Exchange Act, while reassuring the American people that the CFTC will exercise its exclusive jurisdiction over prediction markets," Selig said of the regulatory process which is starting with what's known as an "advanced notice of proposed rulemaking."

Selig, who can operate as the sole authority at the regulator because he's the only member of what's meant to be a five-person commission, quickly moved to push the new policy effort. He's also been waging a rhetorical campaign against state regulators who claim authority over sports betting, saying his agency is the primary regulator of that space. Numerous states sued prediction market providers alleging they're also subject to their jurisdiction, at least for sports-related bets, and Selig filed a recent court brief arguing the CFTC holds sole jurisdiction.

JPMorgan Chase has been sued by investors in Goliath Ventures, with a proposed class action lawsuit alleging the bank ignored “red flags” that the allegedly fraudulent crypto pool raised and helped enable what the complaint describes as a $328 million crypto Ponzi scheme that affected over 2,000 people.

Filed in federal court in the Northern District of California Wednesday, the complaint claims Chase “provided the essential banking infrastructure through which the Ponzi scheme operated,” processing investor deposits, facilitating transfers and enabling payments that allegedly “created the false appearance of legitimate profits.”

Florida resident Christopher Alexander Delgado was arrested last month by federal authorities on wire fraud and money laundering charges tied to his operation of Goliath. That criminal case is in its early stages.

“Numerous red flags made the fraudulent nature of the scheme obvious and known to Chase,” Wednesday's proposed class action claims. “Despite those red flags, Chase turned a blind eye and continued servicing the accounts used to perpetrate the fraud, earning substantial fees from the hundreds of millions of dollars it washed through Goliath and Delgado’s banking activities at Chase.”

A JPMorgan spokesperson toldCoinDesk that the bank would “decline to comment.”

The complaint, filed by Robby Alan Steele through his lawyers at Shaw Lewenz and co-counsel, states that JPMorgan was the sole banking institution for Goliath. It further states that approximately $253 million was deposited into a Chase account linked to Goliath between January 2023 and June 2025. Roughly $123 million was transferred from that account to crypto exchange Coinbase, while about $50 million was sent to investors as purported returns.

The fight over US crypto legislation is turning into a direct clash between digital-asset firms and one of Washington’s oldest power centers. In an interview with Pete Rizzo, Satoshi Action Fund founder and CEO Dennis Porter said the banking industry is preparing a nine-figure lobbying push that could complicate efforts to advance both market structure legislation and stablecoin rules.

Crypto’s D.C. Outlook Just Got Darker
Porter said the core dispute is no longer just about whether Congress wants to regulate crypto, but on whose terms. President Donald Trump has publicly backed keeping the GENIUS Act intact, Porter noted, which he described as a positive sign for crypto firms. But he argued that support from the White House does not resolve the deeper standoff with banks, especially around stablecoins and the issue of rewards programs that banks view as a threat to deposits.

“The bank lobby has come out and said that they do plan to spend to counteract the crypto industry,” Porter said. “They said they’re raising nine figures, which is right up there with the Fairshake number. So that does create that counterbalance where they can essentially assert themselves into the ecosystem and start to peel some of these lawmakers off.”

That matters because, in Porter’s telling, crypto is entering the fight without a clean political backdrop. He said Democrats have grown more cautious around digital-asset legislation as Trump family involvement in the sector has raised ethics concerns among both lawmakers and voters.

At the same time, he described market structure as a far more expansive and politically difficult package than stablecoin legislation, since it touches not only securities-versus-commodities questions but also DeFi, illicit finance, ethics provisions and the makeup of the CFTC.
