CLARITY Act risks handing crypto to centralized players: Gnosis exec



The regulatory provisions outlined in the US Digital Asset Market Structure Clarity Act, otherwise known as the CLARITY Act, threaten to give large financial institutions control over crypto, according to Dr. Friederike Ernst, co-founder of the Gnosis blockchain protocol.

Regulations in the CLARITY crypto market structure bill assume that activity must pass through centralized intermediaries, which risks consolidating crypto rails in the hands of a few entrenched players, Ernst told Cointelegraph.

“Blockchain’s real breakthrough was not just a new financial infrastructure. It was the ability for users themselves to become owners of the networks they rely on," she said. Ernst added:

“If activity is pushed back through institutional intermediaries, users risk becoming customers renting access to financial technology once again rather than stakeholders in it. The challenge is ensuring regulatory clarity does not unintentionally undermine that ownership model.”

Despite the bill’s shortcomings, the CLARITY Act does clarify regulatory jurisdiction over crypto between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC), as well as protects peer-to-peer transactions and self-custody, Ernst said.

However, the failure of the market structure bill to adequately protect open, permissionless blockchain rails and decentralized finance protocols risks bringing all the same points of failure of the legacy financial system to crypto, Ernst said.

Per a CoinShares report published Monday, crypto investor reaction to tensions in the Middle East appears relatively measured, as digital asset investment products have now recorded a three-week run of positive flows. In total, the past three weeks have brought in $2.7 billion in inflows, driving net inflows to around $1.2 billion year to date. Meanwhile, total assets under management in digital asset ETPs have also risen 9.4% to nearly $140 billion, according to CoinShares head of research James Butterfill. With the latest inflows, Bitcoin ETPs have pushed year-to-date gains to $933 million, while Ethereum funds are still in the red with around $23 million in outflows year to date, despite $315 million in inflows last week. World Liberty Financial ($WLFI) holders who want a chance to steer the protocol’s future will now need to lock up their tokens for nearly six months under a newly passed proposal.

The proposal from the Trump family-backed crypto venture closed on Friday with 99.12% of 1,800 votes cast in favor, according to the snapshot governance vote. Over 76% of the tokens came from ten users.

$WLFI said the proposal was to ensure only those with “long-term alignment to the protocol” can make decisions on the protocol.

It also entices stakers with a 2% annual percentage yield on their staked tokens if they participate in at least two governance votes during the lock-up period. Users with already-locked tokens are unaffected and can continue voting as usual.

Low voter turnout has been a recurring issue across decentralized autonomous organizations (DAOs), with some estimates suggesting average participation rates between 15% and 25%.

Ethereum co-founder Vitalik Buterin suggested in February that AI personal assistants could help DAO members vote and increase participation, while Stani Kulechov, the founder of decentralized lending platform Aave has suggested scaling back token holders' votes in favor of more input from leadership. The latest $WLFI proposal offers a different approach to the issue.

One part of the proposal also suggests that those staking 50 $WLFI million tokens, worth about $5 million, could get “guaranteed direct access” to the $WLFI team for collaboration opportunities.
