Japan to Triple Prison Terms for Unregistered Crypto Sales

Japan’s Financial Services Agency will dramatically tighten penalties for unlicensed cryptocurrency sales, Nikkei reported on March 16. Maximum prison terms will more than triple, from 3 to 10 years, under the proposed revision.

The move marks Japan’s clearest signal yet that it will regulate crypto as a full-fledged financial product, not a payment tool.

Penalties Align With Securities-Grade Enforcement

Fines will also rise sharply, from ¥3 million ($20,000) to ¥10 million ($67,000), or to the combined penalty. The changes come as crypto oversight shifts from the Payment Services Act to the Financial Instruments and Exchange Act.

The migration places digital assets under the same legal framework governing stocks, bonds, and derivatives in Japan. Registered operators will be renamed from “crypto asset exchange providers” to “crypto asset trading firms.”

SESC Gets Criminal Investigation Powers

Enforcement is getting sharper teeth as well. Previously, the FSA could only issue warning letters to unregistered operators. The SESC was limited to seeking court injunctions against their business activities.

Under the new framework, the SESC will conduct criminal investigations into unlicensed crypto businesses. It will carry out on-site inspections, seize evidence, and refer cases for prosecution. These powers already exist for securities fraud and insider trading in traditional financial markets.

The expanded penalties will also cover unregistered operators of OTC crypto derivatives, not just spot trading.

Hashdex has lowered the management fee on its multi-asset crypto exchange-traded fund, Hashdex Nasdaq CME Crypto Index ETF [NCIQ], as competition across the U.S. crypto ETF market continues to build.

According to a 16 March 2026 filing, the sponsor fee for NCIQ has been reduced from 0.50% to 0.25% per year, effective immediately. The change was disclosed in an 8-K filing submitted to the U.S. Securities and Exchange Commission.

The fee had previously been temporarily reduced through a waiver set to remain in place until the end of 2026. The new filing makes that lower fee level permanent.

Fee cut strengthens Hashdex’s pitch to investors

The reduction makes NCIQ cheaper for investors seeking diversified exposure to digital assets through a single listed product.

Hashdex said the decision reflects its effort to build more accessible crypto investment products for advisers, institutions, and high-net-worth investors.

The lower fee also comes at a time when fund issuers are increasingly using pricing to compete for flows in the growing crypto ETF market.

NCIQ launched in February 2025 as the first multi-asset spot crypto ETF in the United States. The fund tracks the Nasdaq CME Crypto Index and currently provides exposure to seven crypto assets:

Bitcoin

Ethereum

XRP

Solana

Cardano

Chainlink

Stellar

That structure sets it apart from single-asset spot ETFs tied only to Bitcoin or Ethereum.

Analysts Converge on One Key Level As Bitcoin Reclaims $74,000

Bitcoin ($BTC) briefly surged past $74,000 for the first time in weeks, hitting intraday highs near $74,509. The move marks a 9% weekly gain and a sharp recovery from early March lows near $63,000.

The rally comes as equities and gold remain under pressure from the US-Iran conflict, reviving the narrative that $BTC could serve as a “digital safe haven” amid geopolitical tensions. Analysts who spoke to BeInCrypto agree that $74,000 will determine whether this bounce becomes a trend reversal.

$74,000 Becomes the Line in the Sand

Andri Fauzan Adziima, Research Lead at Bitrue, told BeInCrypto the outlook remains constructive. He pointed to $BTC reclaiming its 50-day moving average (MA) and positive momentum indicators as technical confirmation.

The move also brought gains of roughly 3% over the past 24 hours, driven by a wave of short liquidations and renewed institutional buying.

“Outlook is mildly bullish. If $BTC holds $71,000+ and volume stays elevated, we could target a retest of $74,000–$76,000. If global risk appetite stays positive, this could extend toward higher time frame targets,” Bitrue’s Andri Fauzan Adziima told BeInCrypto.

Kyle Rodda, Senior Financial Analyst at Capital.com, took a more cautious view. He acknowledged that $BTC’s strength against a resurgent dollar suggests its anti-fiat properties are functioning as intended. However, the analyst warned the broader structure still favour sellers.
