Australia Backs Crypto Exchange Licensing Bil

The legislation was first introduced in November 2025 by Assistant Treasurer and Financial Services Minister Daniel Mulino.

Australia's Senate Economics Legislation Committee has recommended passing the Corporations Amendment (Digital Assets Framework) Bill 2025, a move that would bring crypto exchanges and tokenization platforms under the country's existing financial services regime.

The committee endorsed the bill on March 16, advancing a framework designed to close regulatory gaps exposed by the collapse of high-profile digital asset businesses such as FTX. The legislation was first introduced in November 2025 by Assistant Treasurer and Financial Services Minister Daniel Mulino.

Under the bill, DigitalAssetPlatforms (DAPs) and tokenized custody platforms (TCPs) would be classified as financial products under the Corporations Act and the Australian Securities and Investments Commission Act. Most centralized exchanges and tokenized custody businesses holding client assets would be required to obtain an Australian Financial Services Licence.

Licensed platforms must meet ASIC-set custody and settlement standards, follow disclosure requirements for retail clients, and comply with platform-specific conduct and governance rules. Providers with annual transaction volumes below AU$10 million ($7 million) and certain public blockchain infrastructure are exempt.

Ripple Labs supported the use of "control" as the regulatory threshold but warned that the bill's "factual control" test, as written, could misclassify technology providers holding a single key shard in multi-party computation (MPC) setups as regulated custodians. The firm urged lawmakers to specify that factual control requires the ability to transfer an asset without client cooperation.
